Items of Interest Week Ending OCTOBER 23, 2020 Staff Hosted Public Meeting to Discuss Update to Regulatory Guide 1.200 On October 21, 2020, the staff held a public meeting (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20281A556) with industry representatives to discuss the regulatory treatment of newly developed probabilistic risk assessment methods and associated activities, including the planned update to Regulatory Guide (RG) 1.200, An Approach for Determining Acceptability of Probabilistic Risk Assessment Results for Risk-Informed Activities. The primary purpose of the meeting was to discuss the staffs disposition of public comments received on the RG. The U.S. Nuclear Regulatory Commission (NRC) staff was able to establish a shared understanding with industry representatives about how NRC plans to disposition key public comments on the proposed revision to RG 1.200. The staff shared a draft final presentation (ADAMS Accession No. ML20293A488) to brief the Office of the Advisory Committee on Reactor Safeguards Full Committee on the RG 1.200 update on November 5, 2020.
Staff Issued License Amendment for Increase in Licensed Thermal Power Level for Watts Bar Unit 2 On October 19, 2020, the staff issued a license amendment to the facility operating license for Watts Bar Nuclear Plant, Unit 2, that increased the authorized reactor core power level by approximately 1.4 percent rated thermal power from 3411 megawatts thermal (MWt) to 3459 MWt (ADAMS Accession No. ML20226A444). The Tennessee Valley Authority requested the power uprate amendment in a letter dated October 10, 2019 (ADAMS Accession No. ML19283G119), which was based on measurement uncertainty recapture (MUR). MUR power uprates are less than 2 percent and are achieved by implementing enhanced techniques for calculating reactor power. This involves the use of state-of-the-art feedwater flow measurement devices to more precisely measure feedwater flow, which is used to calculate reactor power. Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period is summarized below. Items of Interest Week Ending OCTOBER 23, 2020 NMSS Staff Held Public Workshop on Novel Radiopharmaceuticals and Radiological Devices On October 14, 2020, NMSS staff held a joint public workshop with the U.S. Food and Drug Administration (FDA) on enhancing development of novel radiopharmaceutical and radiological devices. Approximately 550 participants took part and asked questions relating to U.S. Nuclear Regulatory Commission (NRC) and FDA jurisdiction, radiopharmaceutical extravasations, dosimetry, safety, and efficacy considerations for radiotherapies such as alpha-emitting radiopharmaceuticals and yttrium-90 microsphere brachytherapy. A video of the workshop will be available on the NRCs Webcast portal and staff is working with the FDA and other panelists to make slide presentations and Q&As publicly available.
NMSS Staff Held Public Meeting on Transfer of Control Amendment for Water Remediation Technology On October 19, 2020, the NMSS staff held a public meeting with Water Remediation Technology (WRT) to discuss the application process for a transfer of control amendment associated with WRT's license for possession of uranium resulting from the removal of uranium from drinking and other water resources. During the meeting, WRT summarized the change in ownership as a change of majority shareholder in WRTs holding company to a Canadian entity with existing ownership due to the recent death of the current majority shareholder. The meeting was attended by Agreement State partners with their own WRT licenses. The NRC staff and Agreement State representatives discussed with WRT the content that will need to be included in the change of ownership request.
NMSS Staff Issued Temporary Instruction Related to Potential COVID-19 Impacts On October 21, 2020, NMSS staff issued Temporary Instruction TI-003, Evaluating the Impacts of the COVID-19 Public Health Emergency as Part of the Integrated Materials Performance Evaluation Program (IMPEP). The TI, developed in coordination with NRC Regional Offices and the Organization of Agreement States, provides additional guidance to ensure IMPEP review teams appropriately and consistently consider impacts of the COVID-19 PHE. The TI offers flexibility for each IMPEP performance indicator while continuing to maintain public health, safety, and security.
Director of NMSS Participated in a Meeting of the Nuclear Fuel Working Group On October 22, 2020, the Director of NMSS participated in a meeting of the Nuclear Fuel Working Group (NFWG) participants. The purpose of the meeting was to discuss status of Agency activities related to the NFWG report. NRC reported that it is revising the uranium recovery licensing process, developing rulemakings for advanced reactor safety and environmental reviews, working with other agencies to improve the 123 Agreement process, evaluating the license application for Centrus (U.S. Department of Energys HALEU demonstration project), and considering whether to initiate in situ recovery (ISR) rulemaking.

Miscellaneous Corrections: Final rule; 10 CFR Chapter I; RIN 3150-AK48 (NRC-2020-0125)
On October 16, 2020, the NRC published a notice in the Federal Register (85 FR 65656) amending its regulations to make miscellaneous corrections. These changes include redesignating footnotes, correcting references, typographical errors, nomenclature, titles, email addresses, and contact information. This document is necessary to inform the public of these non-substantive amendments to the NRC's regulations. This final rule is effective on November 16, 2020.
Spent Fuel Cask Certificate of Compliance Format and Content: Withdrawal of Petition for Rulemaking; Discontinuation of Rulemaking Activity; 10 CFR Part 72 (PRM-72-7; NRC-2012-0266; NRC-2014-0067)
On October 19, 2020, the NRC published a notice in the Federal Register (85 FR 66285) announcing the withdrawal of petition for rulemaking (PRM)-72-7, and discontinuation of the associated rulemaking activity, Spent Fuel Cask Certificate of Compliance Format and Content. The NRC will no longer track this rulemaking activity or PRM. The docket for the rulemaking was closed on October 19, 2020. The petition was withdrawn on February 25, 2020.
Risk-Informed Categorization and Treatment of Structures, Systems, and Components for Nuclear Power Reactors: Petition for Rulemaking; Consideration in the Rulemaking Process; Part 50 of Title 10 of the Code of Federal Regulations (10 CFR) (PRM-50-110; NRC-2015-0028; NRC-2009-0196)
On October 20, 2020, the NRC published a notice in the Federal Register (85 FR 66498) announcing that it will consider, within the scope of a Commission-directed rulemaking
[Incorporation of Lessons Learned from New Reactor Licensing Process (Parts 50 and 52 Licensing Process Alignment)], the issue raised in a PRM submitted by Michael D. Tschiltz, on behalf of the Nuclear Energy Institute, dated January 15, 2015. The petitioner requested that the NRC amend its regulations to clarify and extend the applicability of its regulations related to risk-informed categorization and treatment of structures, systems, and components for nuclear power reactors. The petition was docketed by the NRC on February 6, 2015, and was assigned Docket No. PRM-50-110. The NRC has determined that the PRM has merit and is appropriate for consideration in the rulemaking process. The docket for the petition for rulemaking, PRM-50-110, was closed on October 20, 2020.
