Items of Interest Week Ending APRIL 3, 2020 Oklo Submits a Custom Combined License Application for the Aurora Powerhouse (Micro-Reactor)

On March 11, 2020, Oklo Power, a subsidiary of Oklo Inc., submitted a custom combined license application for the Aurora Powerhouse (micro-reactor) to be located at the Idaho National Laboratory. The public version of the application is available under ADAMS Accession No. ML20075A000.

NRC Staff Issues Updated Inspection Manual Chapter 2515, Appendix E On March 27, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff updated Inspection Manual Chapter 2515, Appendix E, "Inspection Program Modifications During Pandemics, Epidemics, or Other Widespread Illnesses or Diseases" (ADAMS Accession No. ML20079E700) to update guidance regarding reactor oversight process inspection program modifications, resident inspector site staffing, the expanded use of technology and other considerations to perform inspections remotely.

Public Meeting to Discuss Existing Methods to Request Temporary Regulatory Changes to Operator Licensing Programs Due to COVID-19 On March 27, 2020, the staff held a public teleconference with industry representatives to discuss the existing methods to request temporary regulatory changes to operator licensing programs due to COVID-19. The industry representatives indicated an interest in the NRC regulatory action in three areas: continuing certain initial license examinations, some of which have been postponed due to social distancing concerns; biennial requalification examination and medical requirements; and initiating license applications, with the examination waived under 10 CFR 55.47, for employees who recently terminated their operator licenses. Industry representatives indicated the intent to provide additional information to support the NRC efforts to address the requested actions, and staff is currently evaluating regulatory options.

Items of Interest Week Ending APRIL 3, 2020 Clarification of Personnel Access Authorization Requirements for Non-Immigrant Foreign Nationals Working at Nuclear Power Plants: Chapter I of Title 10 of the Code of Federal Regulations (10 CFR); NRC-2020-0073 On March 30, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (85 FR 17770) seeking public comment on a draft regulatory issue summary to reinforce the existing requirement that prior to granting or reinstating unescorted access, or certifying unescorted access authorization to non-immigrant foreign nationals for the purpose of performing work, licensees shall take reasonable steps to access reliable, independent sources of information, in addition to the information provided by the applicant, to verify the applicants claimed non-immigration status. Comments are requested by April 30, 2020.

Retrospective Review of Administrative Requirements: Request for Comment; Extension of Comment Period; 10 CFR Chapter I; (NRC-2017-0214)

On April 2, 2020, the NRC published a notice in the Federal Register (85 FR 18477) extending the comment period for a document published on February 4, 2020 (85 FR 6103), which requested input from its licensees and members of the public to identify outdated or duplicative administrative requirements that may be eliminated without an adverse effect on public health or safety, common defense and security, protection of the environment, or regulatory efficiency and effectiveness. The public comment period originally was scheduled to close on April 6, 2020. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments. Comments should be filed no later than May 6, 2020.

List of Approved Spent Fuel Storage Casks: TN Americas LLC NUHOMS EOS Dry Spent Fuel Storage System; Certificate of Compliance No. 1042, Amendment No. 1; Direct Final Rule; 10 CFR Part 72 (RIN 3150-AK40; NRC-2019-0224)

On April 3, 2020, the NRC published a notice in the Federal Register (85 FR 18857) amending its spent fuel storage regulations by revising the TN Americas LLC NUHOMS EOS Dry Spent Fuel Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 1 to Certificate of Compliance No. 1042. The companion proposed rule was also published on April 3, 2020 (85 FR 18876). This direct final rule is effective June 17, 2020, unless any significant adverse comment is received by May 4, 2020.
