On March 20, 2019, the NRC published a document in the Federal Register (84 FR 10257) correcting a direct final rule published on June 6, 2017 (82 FR 25931 ), which was effective on August 21, 2017. The technical specifications for NAC International MAGNASTOR Cask System, Amendment No. 7 included a minor editorial and non-substantive error. The purpose of this action was to correct the error. This rule was effective on March 20, 2019.

Enhanced Security of Special Nuclear Material: Revised Regulatory Basis; Extension of Comment Period; 10 CFR Part 73 {RIN 3150-AJ41; NRC-2014-0118)

On March 20, 2019, the NRC published a document in the Federal Register (84 FR 10269) extending the public comment period for a draft revised regulatory basis published on March 1, 2019 (84 FR 6980), to allow members of the public more time to develop and submit their comments. The public comment period , originally scheduled to close on April 1, 2019, is extended . Comments should be filed no later than April 19, 2019.

Items of Interest Week Ending March 22, 2019 DPO Decision On February 28, 2019, the Regional Administrator (RA) for the U.S. Nuclear Regulatory Commission's (NRC's) Region IV office issued a formal decision on a Differing Professional Opinion (DPO) submitted on October 31 , 2017, involving the results of a Problem Identification and Resolution (Pl&R) inspection conducted at the Cooper Nuclear Station (CNS). Specifically, the DPO stated that five NRC Region IV staff findings and/or violations documented in the CNS Pl&R inspection report 05000298/2017010 were either not violations of NRC requirements, were inconsequential and thus should not have been documented, or were otherwise not adequately supported by the information provided in the report. On April 13, 2018, an Ad Hoc Panel (Panel) provided the results of its independent review of the DPO to the former Region IV RA, who had not decided the matter prior to his retirement from the NRC in December 2018.

The succeeding RA conducted a thorough review of all the information gathered regarding this DPO and subsequently agreed with the Panel's conclusions, issued a formal directive to his staff that the CNS Pl&R inspection report be modified and reissued , and provided several Reactor Oversight Process related recommendations to the program office director at NRC headquarters. DPO 2018-003 - Power Reactor Licensee Changes to Security Plans Submitted under Title 1O of the Code Of Federal Regulations 50.54(P)(2)

DPO Decision On February 1, 2019, the Director, Office of Nuclear Security and Incident Response (NSIR) issued a decision on a Differing Professional Opinion (DPO) submitted on May 3, 2018, regarding the U.S. Nuclear Regulatory Commission's (NRC) implementation of the regulatory framework governing power reactor licensee changes to security plans submitted under Title 1O of the Code of Federal Regulations (10 CFR) 50.54(p)(2). Specifically, the DPO raised concerns that there is a lack of a clear and understandable regulatory framework governing the Commission's meaning and intent for security plan changes submitted under the provisions of 10 CFR 50.54(p)(2) relative to Commission-approved security plans, security plan content/description requirements, baseline inspection activities, and records collection requirements. On November 15, 2018, an Ad Hoc Panel (Panel) provided the results of its independent review of the DPO to the Director of NSIR. The Director of NSIR agreed in principle with the Panel's conclusions and recommendations , and provided clarifications as well as additional recommendations.
