Items of Interest Week Ending February 8, 2019 Issuance of Revision 3 of the Digital l&C Integrated Action Plan On January 31, 2019, the staff issued Revision 3 (ADAMS Accession No. ML19025A312) to the Integrated Action Plan (IAP) to modernize the digital instrumentation and controls (l&C) regulatory infrastructure. Revision 3 to the IAP provides updates to on-going Modernization Plans (MPs) #1-4. Revision 3 includes two new activities: (1) MP #1 D, Update to Branch Technical Position (BTP) 7-19, "Guidance for Evaluation of Diversity and Defense-In-Depth in Digital Computer-Based Instrumentation and Control Systems," and (2) MP #28, Implement Inspector Training and Conduct Stakeholder Workshops on New Digital l&C 10 CFR 50.59 guidance.

Digital l&C Public Meeting On January 31, 2019, the NRC staff held a digital l&C public meeting to discuss its plans for updating Branch Technical Position (BTP) 7-19 to address defense-in-depth for common cause failure, review of alternative International Electrotechnical Commission (IEC) standards for potential endorsement, and the broader assessment of the regulatory infrastructure. In addition, the Nuclear Energy Institute (NEI) presented its digital l&C strategy for 2019, which included their view of four regulatory barriers and proposed solutions. The meeting was well attended by NEI, major utilities, vendors, and members of the public.

Items of Interest Week Ending February 8, 2019 Adjustment of Civil Penalties for Inflation for Fiscal Year 2019: Final Rule; Parts 2 and 13 of Title 10 of the Code of Federal Regulations (10 CFR) (Regulatory Identifier Number 3150-AK02; NRC-2017-0088]

On February 7, 2019, the NRC published a document in the Federal Register (84 FR 2433) amending its regulations to adjust the maximum civil monetary penalties it can assess under statutes enforced by the agency. These changes are mandated by the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. The NRC is amending its regulations to adjust the maximum penalty amount for a violation of the Atomic Energy Act of 1954, as amended (AEA), or any regulation or order issued under the AEA, from $290,875 to $298,211 per violation, per day.

Additionally, the NRC is amending provisions concerning program fraud civil penalties by adjusting the maximum penalty amount under the Program Fraud Civil Remedies Act from

$11,181 to $11,463 for each false claim or statement. This final rule was effective on February 7, 2019.

Enhancing Reactor Safety Petition for Rulemaking : Petition for Rulemaking; Denial; 10 CFR Parts 50, 52, and 100; (PRM-50-99; NRC-2011-0189]

On February 6, 2019, the NRC published a document in the Federal Register (84 FR 2069) denying a petition for rulemaking (PRM) 50-99, dated July 26, 2011, submitted by the Natural Resources Defense Council, Inc. (the petitioner). The petitioner requested that the NRC amend its regulations to require nuclear facilities to confirm seismic and flooding hazards every 1O years and to address any new and significant information. The NRC did not request public comment on this petition because the staff had sufficient information to review the issues raised in the PRM. The NRC is denying the petition because the NRC is addressing the issues raised in the petition using an approach other than rulemaking . The docket for PRM-50-99 was closed on February 6, 2019.
