Office of Nuclear Material Safety and Safeguards (NMSS)

On January 31, 2019, the NRC published a document in the Federal Register (FR) (84 FR 578) proposing to amend the licensing, inspection, special project, and annual fees charged to its applicants and licensees. These proposed amendments are necessary to implement the Omnibus Budget Reconciliation Act of 1990, as amended, which requires the NRC to recover approximately 90 percent of its annual budget through fees, less certain amounts excluded from this fee-recovery requirement. President Trump signed the Energy and Water, Legislative Branch, and Military Construction and Veterans Affairs Appropriations Act on September 21, 2018. That Act appropriated approximately $911.0 million to the NRC, which is a decrease of approximately $11.0 million from FY 2018. Based on that total budget authority, the NRC is proposing to collect $781.9 million in fees in FY 2019. Comments are requested by March 4, 2019.

Ground Water Protection at Uranium In Situ Recovery Facilities: Request for Comment; 10 CFR Part 40 (RIN 3150-AI40; NRC-2008-0421)

On January 31, 2019, the NRC published a document in the FR (84 FR 574) requesting views from interested stakeholders on whether the NRC should resume rulemaking to amend its regulations governing the domestic licensing of source material by codifying general requirements to address ground water protection at uranium in situ recovery (ISR) facilities. The NRC currently regulates ISR operations through application of regulations that primarily focus on conventional uranium mills and site-specific license conditions. The NRC initiated rulemaking in 2006 to develop requirements to provide regulatory consistency and improve the efficiency of the ISR licensing process, but placed this rulemaking on hold in 2010. Information provided to the NRC during the public comment period will be factored into the decision as to whether the NRC will continue this rulemaking. Comments are due by March 4, 2019.

Region IV Items of Interest Week Ending February 1, 2019 Summary of Decision on DPO 2018-001:

  • On January 31, 2019, the Regional Administrator (RA) of Region IV issued a decision (Decision) on the subject Differing Professional Opinion (DPO). The DPO stated that the results of a supplemental inspection conducted at Columbia Generating Station (CGS) per NRC Inspection Procedure (IP) 95001 were not supported by the information documented in the associated inspection report (CGS report 2017-011 dated January 30, 2018), and that the NRC staff inappropriately closed the WHITE finding in the Public Radiation Safety cornerstone. The DPO also raised a concern that a potential violation 10 CFR 50.5 may have occurred. The Decision concluded that that the 95001 inspection team conducted a thorough review of the CGS staffs actions to assess the root and contributing cause(s) of the radioactive waste shipping incident that led to the WHITE finding, and to implement necessary actions to correct the identified deficiencies and preclude their recurrence. The Decision also stated that the inspection staff met the objectives of IP 95001 and that their basis for closing the WHITE finding was appropriate and sufficient. However, the Decision also concluded that the associated IP 95001 inspection report was not sufficient to enable an independent reader to attain the level of confidence necessary to conclude that the NRC staff fully and independently assessed the licensees actions. Given this determination, the RA directed the Region IV Division of Reactor Safety (DRS) staff to prepare and issue an addendum to the publicly available 95001 report which provides supplemental information that, in part, (1) affirms that the IP 95001 objectives were met, (2) explains the rationale for the minimal level of detail in the original report (e.g., notes that DRS management made a conscious decision to not reiterate assessments already reached in other publicly available NRC inspection reports), and (3) describes how the compendium of licensee work products (listed in the original inspection report) and NRC inspection activities led to the decision to close the WHITE finding. Finally, the Decision concluded that there was no evidence to support a 10CFR 50.5 violation at CGS.
