Items of Interest Week Ending NOVEMBER 2, 2018 Categorization of the Licensee Fee Category for Full-Cost Recovery: Petition for Rulemaking (PRM); Notice of Docketing; Parts 170 and 171 of Title 10 of the Code of Federal Regulations; (PRM-170-7) NRC-2018-0172)

On November 2, 2018, the NRC published a notice of docketing (83 FR 55113) for a PRM submitted by Mr. Christopher S. Pugsley, Esq ., on behalf of Water Remediation Technology, LLC, dated July 3, 2018, requesting that the NRC amend its regulations regarding full-cost recovery of licensee fees. The petition was docketed by the NRC on August 2, 2018, and has been assigned Docket No. PRM-170-7. The NRC is examining the issues raised in PRM-170-7 to determine whether they should be considered in rulemaking. The NRC is not instituting a public comment period for this PRM as the staff anticipates considering the issues raised in the petition in the upcoming fiscal year 2019 proposed fee rule, and the public will have an opportunity to comment at that time . The PRM was available on November 2, 2018.

Items of Interest Week Ending NOVEMBER 2, 2018 Differing Professional Opinion Appeal Decision On May 11, 2018, the Executive Director for Operations (EDO) issued a decision on the appeal of DP0-2017-003. Because of discovery of an administrative oversight, this decision from May is being included in this weekly information report. DP0-2017-003 concerns the NRC Region IV decision involving the very low safety significance (GREEN) characterization of an inspection finding and associated Non-Cited Violation (NCV)05000416/2016004-02, "Failure to Use Procedures and Engineering Controls to Maintain Occupational Doses ALARA" at the Grand Gulf Nuclear Station . The EDO's decision on the appeal supported both the DPO ad-hoc review panel's independent technical conclusions and the Regional Administrator's decision; and recommended specific actions consistent with, and in addition to, the Regional Administrator's decision in order to address the concerns raised in this DPO. The DPO ad-hoc review panel concluded that (1) Region IV inspection staff correctly computed the three year collective dose average and correctly followed the associated guidance for the Significance Determination Process when making the determination of the associated ALARA violation contained in inspection report 05000461/2016004, and (2) the ALARA Significance Determination Program using the three year rolling average has adequately served the NRC's oversight process since its inception in the early 2000s. No public health and safety issue or undue health risk was missed from the use of the three year rolling average. The EDO noted that the manner in which the concerns were raised and the process by which they were considered are indicative of the Agency's success in establishing and maintaining an environment in which employees at all levels and disciplines feel comfortable raising concerns.
