No. II-09-022 April 21, 2009 CONTACT: Roger Hannah (404) 562-4417 E-mail: OPA2@nrc.gov Joey Ledford (404) 562-4416 NRC SCHEDULES ENFORCEMENT CONFERENCE WITH GLOBAL NUCLEAR FUEL The Nuclear Regulatory Commission staff has scheduled a predecisional enforcement conference in Atlanta for Thursday, April 30 to discuss with officials of Global Nuclear Fuel --
Americas, LLC of Wilmington, N.C. an apparent violation of NRC requirements associated with the facilitys criticality warning system.
The meeting will begin at 10 a.m. at the NRC Region II office in Atlanta, located in the Sam Nunn Atlanta Federal Center, 61 Forsyth St., S. W., Suite 23T85. The meeting will be open to observation by the public, and NRC officials will be available at its conclusion to answer questions from interested observers. Members of the public interested in attending the meeting or participating by toll-free audio teleconference should contact the NRC=s Richard Gibson at 404-562-4718 or richard.gibson@nrc.gov or Chad Cramer at 404-562-4712 or chad.cramer@nrc.gov.
An NRC inspection in February reviewed a situation in December 2008 where the facilitys criticality warning system had been switched from the automatic to manual mode for four days without proper monitoring to ensure alarm activation should an accidental nuclear criticality occur. The NRC inspector concluded that the companys investigation was satisfactory and proposed corrective actions were adequate, but an apparent violation was noted and the enforcement conference scheduled.
No decision on enforcement action will be made at the meeting. NRC officials will review information presented by Global Nuclear Fuel at the meeting and reach a decision on appropriate regulatory action at a later date.
An NRC report with information on the issue is available through the Region II office or through the NRC Web page at www.nrc.gov/reading-rm/adams.html. The number to access the document is ML090850208.
