No: 14-008 February 11, 2014 CONTACT: Scott Burnell, 301-415-8200 Atomic Safety and Licensing Board to Hold Oral Argument On Dresden Confirmatory Order March 6 in Morris, Ill The Atomic Safety and Licensing Board (ASLB) will hear oral arguments March 6 in Morris, Ill., involving a challenge to the NRCs October 2013 Confirmatory Order to the Dresden Nuclear Power Station. The ASLB is the independent body within the NRC that conducts adjudicatory hearings and renders decisions on legal challenges to licensing and enforcement actions.

The oral argument will start at 9:30 a.m. on March 6, in the Grundy County Court House at 111 E Washington St. in Morris. Members of the public and media are welcome to observe the proceeding, but participation will be limited to the parties: Local Union No. 15, International Brotherhood of Electrical Workers; Exelon, the plant owner; and the NRC. Those planning to attend should arrive at least 15 minutes early to allow time for security screening, including searches of hand-carried items such as briefcases or backpacks. No signs will be permitted in the courtroom. The courthouse prohibits cameras of any kind, including cell phone cameras.

The union is challenging the Confirmatory Order, which involves changes to Dresdens behavioral observation program. The NRC and Exelon used the Alternative Dispute Resolution process to formulate the program changes. The oral argument will examine whether the union has established a right to an evidentiary hearing on its challenge to the Confirmatory Order.
