NRC NEWS U.S. NUCLEAR REGULATORY COMMISSION Office of Public Affairs Telephone: 301/415-8200 Washington, D.C. 20555-0001 E-mail: opa.resource@nrc.gov Site: http://www.nrc.gov No.10-079 May 3, 2010 NRC ANNOUNCES SUPPLEMENTAL OPPORTUNITY TO PARTICIPATE IN HEARING ON NEW REACTOR APPLICATION FOR VOGTLE SITE The Nuclear Regulatory Commission today announced an additional opportunity to participate in the hearing on a Combined License (COL) application for two new reactors at the Vogtle site near Waynesboro, Ga.

Southern Nuclear Operating Co. submitted the COL application and associated information March 28, 2008, seeking a license to build and operate two AP1000 reactors at the site, about 26 miles southeast of Augusta, Ga. Southern supplemented the application on Oct. 2, 2009, requesting a Limited Work Authorization (LWA) for work related to laying concrete and embedded items for the foundation of the proposed plants nuclear island. Southern provided additional information on the LWA request on Feb. 5 and March 11, 2010. The application (minus proprietary and security-related details), is available on the NRC Web site at:

The NRC staff has determined that the LWA application contains sufficient information for the agency to formally docket, or file, the application and begin its technical review.

Docketing the application does not preclude requests for additional information as the review proceeds; nor does it indicate whether the Commission will issue the license.

The additional notice of opportunity to intervene in the hearing is limited to the LWA request. The notice appeared in the Federal Register on May 3 (http://edocket.access.gpo.gov/2010/pdf/2010-10234.pdf ), and the deadline for petitioning to intervene is July 2. Petitions may be filed by anyone whose interest may be affected by the proposed LWA, who wishes to participate as a party in the proceeding, and who meets criteria set out in the NRCs regulations.

A petition to intervene must be electronically submitted by July 2 to the NRC's Electronic Information Exchange (EIE) system. The petition to intervene must be filed in accordance with the NRC's E-Filing Rule, which appeared in the Federal Register on Aug. 28, 2007 (http://edocket.access.gpo.gov/2007/pdf/E7-16898.pdf ). Southerns LWA request for the Vogtle foundation work is separate from the authorization contained in the Early Site Permit issued by the NRC on Aug. 26, 2009.
