S. Nuclear Regulatory Commission (NRC) issued Order EA-02-026, Order for Interim Safeguards and Security Compensatory Measures, to Nuclear Management Company, LLC (NMC) for Palisades Nuclear Plant (PNP). In Reference 2, the NRC issued an Order approving the transfer of the PNP operating license from NMC to Entergy Nuclear Operations, Inc. (Entergy).
In Reference 3, Entergy notified the NRC that it has decided to permanently cease operations at PNP no later than May 31, 2022. Once certifications for permanent cessation of operations and permanent removal of fuel from the reactor vessel are submitted to the NRC in accordance with NOTICE: The Enclosure to this letter contains "Safeguards Information." Upon separation of the Enclosure from this letter this page becomes "DECONTROLLED."

SAFEGUARDS INFORMATION PNP 2021-013 Page 2 of 2 Title 10 of the Code of Federal Regulations, Part 50, Section 82 (10 CFR 50.82), Termination of license, Subparagraphs 50.82(a)(1)(i) and (ii), per 10 CFR 50.82(a)(2), the 10 CFR part 50 license no longer authorizes operation of the reactor or emplacement or retention of fuel into the reactor vessel.
In accordance with Section 111.D of Order EA-02-026, a request to rescind Interim Compensatory Measure (ICM) 8.1.a is provided in the enclosure to this letter. The recission request is part of the transition from an operating facility to a non-operating facility. The enclosure to this letter provides the basis for rescission of the subject security order and contains Safeguards Information as defined by 10 CFR 73.21, Protection of Safeguards Information: Performance Requirements, and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended.
Entergy requests recission of the Order no later than May 31, 2022 and that the recission become effective immediately following submittal of the required 1 O CFR 50.82(a)(1 )(ii) certification that Entergy has permanently removed fuel from the PNP reactor vessel.
This letter contains no new commitments and no revised commitments.
