NEW JERSEY SEEKING TEMPORARY RESTRAINING ORDER TO PROHIBIT MOVEMENT OF SHOREHAM FUEL The State of New Jersey has made public its intent to request in Federal court tomorrow (September 22, 4
1993) a Restraining Onler which would prohibit the Long Island Power Authority from shipping irradiated fuel from the Shoreham Nuclear Power Station to Philadelphia Electric Company's Limerick Station. The fuel was used at Shoreham in a limited testing program at a maximum of 5% power. The shipments, 33 total, which would occur over an eleven-month period, are scheduled to begin the week of September 20,1993. Although the NRC staff has not yet seen the Comt Filing, we understand that the State's arguments will address environmental issues.
NRC Region I currently has inspectors at the Shoreham site inspecting the shipment preparations and plans to cover the start of the shipment. The Commonwealth of Pennsylvania, and the States of New York, New Jersey, and Delaware have been notified. This infonnation is current as of 4:00 p.m., on September 21,1993.
The Region is prepared to address media inquiries.
