CLOSURE OF INVESTIGATION (OI 4-2010-079)
Dear Mr. Bannister:
This refers to an investigation conducted by the NRCs Office of Investigations regarding activities at the Fort Calhoun Station. The Office of Investigations initiated the investigation to determine whether inaccurate or incomplete information was willfully submitted to the NRC by the Fort Calhoun Station during a regulatory conference on August 18, 2010.
Specifically the Office of Investigations was tasked to determine whether Fort Calhoun Station willfully provided incorrect probabilistic risk information to the NRC during a regulatory conference, and whether Fort Calhoun Station personnel willfully failed to correct calculations after receiving notification from the NRC prior to the conference that the calculations used by Fort Calhoun Station were incorrect.
Based on the evidence developed, the NRC staff did not substantiate these concerns. The NRC plans no further action related to the willful aspects of this allegation and considers this investigation closed.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
