NRC STAFF'S RESPONSE TO JOHN F. DOHERTY'S CONTENTION NO. 46 On January 8,1980, John F. Doherty filed a cleading which is, in effect, a motion to admit an additional contention as an issue in controversy in the captioned proceeding.

The crux of Mr. Doherty's contention 46 is that:

... control rods caoable of causing a five second period on being withdrawn one notch, if uncoupled from their drives and stack in the core, could, by falling several notches moments later cause a significantly shorter oeriod leading to fuel damage.

As a basis for the contention, Mr. Doherty cites the recent publication of NUREG-0572, an ACRS report entitled " Review of Licensee Event Reports (1976-1978)."

In the referenced report, the ACRS expresses the same concern as that expressed in the contention.

Since the Staff is currently in the process of precaring a report addressing the ACRS concern, we believe that, at present, Mr. Doherty has provided an adequate basis for the contention and that it meets all of the requirements of 10 CFR 52.714.

Further, since the cenesis of the contention involves new information aopearing in a previously unavailable document, the Staff believes that the contention has been raised in a timely manner. As the Commission noted in Indiana and flichigan Electric Co., et al. (Donald C. Cook 1855 211

W Nuclear Plant Units 1 and 2), CLI-72-25, 5 AEC 14, 14 (1972):

[W]e note our longstanding practice of permitting amend-ments to petitions to intervene for good cause shown.

Unless special considerations dictate otherwise in specific circumstances, new information appearing in previously unavailable documents would generally con-stitute good cause for amendment, assuming of course that the request to amend is expeditiously presented and is otherwise proper.

For the above reasons, we support the admission of Mr. Doherty's Contention 46 as an issue in controversy.
