Dear Governor James:

I wish to call to your attention the results of a study made by an NRC Task Force on the regulation for health and safety of naturally occurring and accelerator produced radioactive materials (NARM), a copy of which is enclosed.

The study was initiated as a result of a request from the Conference of Radi-ation Control Program Directors, Inc., that the NRC seek authority to regulate these materials.

The Task Force found that NARM are widely used but that the regulation of NARM is fragmented, non-uniform and incomplete at both Federal and State levels.

These points are reinforced in a " Report on Radiation Health and Safety,"

December 1978, prepared by the Senate Committee on Commerce, Science and Transportation.

I am bringing this matter to your attention because the States have a direct

. interest in this matter.

While the NRC could logically regulate NARM given legislative authority - NRC is not presently pursuing that authority because it believes that such efforts should be integrated into the larger effort to properly allocate Federal responsibilities for radiation protection.

The Interagency Task Force on Ionizing Radiation has recently recommended the establishment of an Interagency Federal Radiation Council which would be as-signed numerous functions, including censideration of basic issues of. policy relating to radiation protection and evaluation of the overall direction and effectiveness of Federal activities in that area.

We believe that :many of the key issues related to the regulation of NARM could be best addressed by such an Interagency Council.

Accordingly, we intend to bring this matter before the Council when it has been established.

In addition, we plan to discuss the

. matter of NARM regulation with the staffs of appropriate Congressional com-mittees, appropriate Federal agencies, and the other States with a view to assisting in efforts to develop effective Federal radiation protection for NARM.

In the meantime, we stand ready to assist you in any way we can to further develop model NARM control programs and to determine what the opportunities and prospects are for working with the States in dealing with their NARM concerns.
