Dear Mr. Quay:

This letter transmits the results of the AP600 FOAKE Design Assurance Review as requested in the Reference I letter. This information is being provided to close the unresolved item identified in the subject NRC inspection. The review was performed by a team of engineers, independent of AF600, under the leadership of management from the Westinghouse Nuclear Service Division. Deliverables were reviewed according to the plan defined in the attachment and potential issues identified. Issues

identified by the team are also presented in the attachment along with the AP600 FOAKE disposition.

The actions initiate.d by the AP600 project and resolution of the teams comments were reviewed and concurred with by the review team.

Reference 2 sets forth the NRC assessment of the Westinghouse claim for treatment of proprietary 7Q 4j information submitted by Westinghouse in a letter dated October 16,1997, which letter provided the Westinghouse response to the Nuclear Regulatory Commission inspection #99900404/97-01. The NRC assessment was that no portion of the Westinghouse letter was marked as proprietary, no nonproprietary version was provided and that, in their opinion, nothing in the letter met the requirements of 10 CFR 2.790(a)(4). The NRC determination was based,in part, on the Westinghouse letter of April 17,1998. addresses the NRC comments in reference 2 by providing a nonproprietary version of the material as discussed with the staff on August 21,1998. The type of material considered nonproprietary in this revision is consistent with that of the Westinghouse letter of April 17,1998.

As part of the Westinghouse oversight of technical activities of the vendors used by Westinghouse for the AP600 program, a design assurance review was performed. The objective was to review (via sample) the design deliverables provided by AP600 design participants to demonstrate that they consist of the level of integrity in design verification and quality assurance necessary required by the project. This review was conducted in accordance with the plan defined by AP600 Project Management. Deviations from the plan were made where the team felt the review was in an area recently checked and would be unlikely to discover new information. As an example QA p egram Plans have been reviewed extensively by ESBU-OA, consequently this was not inciuded in our review.

SCOPE OF REVIEW The review focused on safety related and licensing basis design work products. The firms that were included in the review are given below, along with the description of their responsibilities within the AP600 program.

REVIEW TEAM The review team was established drawing on technical experts within and without Westinghouse. It was assembled to represent all major technical disciplines. The team members were asked to review documents within their areas of expertise.

There was a Westinghouse Quality Assurance representative on the team. Representatives from AP600 projects were also in attendance.

PROCEDURE After establishing the comm;ttee membership and scope of review as defined by the AP600 project management, the packages for review were identified. The process / procedure used to select the review packages is given below:

- types of documents for review

- selection of documents based on significance to design, representing vendor scope of responsibility, and potential impact on other interface areas.

Each of the participants focused on the following areas in their review of the identified vendor packages:

1) Applicability of the analysis and modeling methods

2) Reference to current analysis or design input

3) Compatency of the engineer and verifier understanding and using U.S. codes and standards

4) Verification techniques used by the verifier

5) Verification of computer codes and macros used

6) Adequacy of documentation; comments and observations are documented clearly

7) Accuracy of portions of the analysis calculation selected for review

8) Commitment to incorporating comments and corrections to calculations Where it was not possible to make a conclusion or observations related to an above item due o insufficient information in the package, it was so noted in the individual's review. Responsibb engineers in the participating organizations were contacted by members of the review team when additional information was needed for clarification or to address questions.

In addition to the above, a number of the firms were contacted by telecon to evaluate:

computer code documentation and error reports; technical qualifications of engineers; disposition of Westinghouse's comments; verification process; and internal OA procedures.

The interviews were held to assess first hand, the firms management commitment to quality.

It is noted that a review was performed at the Batan offices with BPPT representatives. During this review, the aforementioned areas were covered and documented in a report. INITEC was not included since these areas were evaluated in a separate OA/ Technical audit performed in

the INITEC offices in May by Westinghouse.

Review documents were provided to each of the members of the review team as selected by the team leader and AP600 project representatives. The documents selected for review are l

identified in Table 1. Table 1 summarizes the potentially significant technical and I

documentation quality issues identified by the review. Documents were not reviewed for CBI, P. Rizzo Assoc., and A. Danay. CBI was evaluated through discussions with an independent reviewer. No documents were reviewed from P. Rizzo Associates since their work is well I

known by Westinghouse, they have been used as consultants and contracted to perform l

engineering tasks for many years, and have been audited by Westinghouse many times. A.

Danay is performing work under the Westinghouse CA program, and the verification is performed by Westinghouse. Each reviewer documented their reviews.

SUMMARY

In the design assurance review, potentially significant technical and documentation quality I

issues were identified and summarized in Table 1 for the documents reviewed. They are of different levels of significance varying from a mistake to the need of addressing the use of preliminary or yet undefined data, or providing formal documentation for information provided to the vendors. It is recommended that a corrective action plan be established by the AP600 Project to address these potentially significant items as appropriate, or to formally document that the issue identified is not significant requiring corrective action. Other comments made by the reviewers are considered to be improvements and good practices. The individual review team reports should be studied by the AP600 responsible design groups since they contain I

additional recommendations to improve the documents, identification of conservatism in the design, and improvements for future consideration.
