Dear Ms. Craig:

1 i The purpose of this letter is to provide to the NRC a clarification of the information provided in the l subject letter of November 21,1996 regarding Westinghouse's position with respect to the proprietary j classification of previously submitted information on the topic ofIncomplete Rod Cluster Control ! Assembly (RCCA) Insertion. In your four letters to Westinghouse, all dated October 16,1996,you l detailed information from meeting presentation material that had been voluntarily submitted by Westinghouse, from meetings held on March 25, May 15, June 27, and September 9,1996, that was j considered proprietary by Westinghouse, to which the NRC did not agree with the proprietary i classification. ! Upon our further detailed review of this information we have determined that we are indeed willing to j permit public disclosure of the majority of the items outlined in your four letters dated October 16, ! 1996. As stated in our letter of November 21,1996 (NSD-NRC-96-4889), we want to make it clear that we still consider the information which we are willing to release to be proprietary, but we have concluded as a matter ofjudgement that the value of such information to us is outweighed by the value of reaching an amicable agreement with the NRC on this important issue. { To this end, we authorize the public disclosure of the infr: nation outlined in your four letters dated d October 16,1996 wherein you disagreed with our proprietary classifications, with the exception of the following: ! , Westinghouse must respectfully disagree with your conclusion and ask that this material remam proprietary and not be disclosed to the public. Westinghouse has reviewed its documentation and i verified that this information is indeed proprietary and must be afforded the requisite safeguards from l j public disclosure. Y. i + In addition,it is noteworthy to reiterate herein that the NRC staff has already agreed to maintain as

proprietary other information contained in the referenced documents and we request that proprietary l protection continue to be provided to that information as well.
