Nuclear Management Company, LLC, former license holder for Point Beach Nuclear Plant (PBNP), Units 1 and 2, submitted an application for renewed operating licenses via Reference (1).

Commitment 30 of the application contained the following proposed Regulatory Commitment:

"Implement an enhanced reactor vessel internals program." The due date or frequency of this commitment was proposed to be "prior to the period of extended operation."

The proposed Regulatory Commitment was subsequently documented in Reference (2),

Appendix A, Commitments for License Renewal of PBNP, as Commitment 29.

lmplementation of Regulatory Commitment 29 by NextEra Energy Point Beach, LLC (NextEra) is dependent upon:

1 Commission review and approval of Electric Power Research Institute (EPRI) Topical Report 1016596, "Materials Reliability Program: Pressurized Water Reactor lnternals Inspection and Evaluation Guidelines (MRP-227)" (TAC ME08680) (ML090160204). A letter from the NRC to EPRI dated December 14, 2009 (ML093420520) indicated that the'milestone schedule for issuance of the draft safety evaluation is August 30, 2010.

2. Subsequent Commission review and approval of the PBNP reactor vessel internals program submitted via Reference (3).

PBNP Unit 1 will enter the period of extended operation on October 5, 2010. Based upon the currently published milestone schedule for the approval of MRP-227, it is unlikely that staff review of the PBNP reactor vessel internals program can be completed prior to Unit Ientering the period of extended operation.

Accordingly, it is proposed that the due datelfrequency for Regulatory Commitment 29 be revised to be "within 180 days following Commission approval of the program." The proposed due date change provides sufficient time for NextEra to revise and fully implement the program to conform to the provisions of Commission's safety evaluation. The proposed change was discussed between representatives of NextEra and the NRC during a teleconference held on April 20, 2010.

Accordingly, the revised Regulatory Commitment is:

"Implement an enhanced reactor vessel internals program." The due date of this commitment is "within 180 days following approval of the program by the NRC."
