Confirmatory Order (Effective Immediately)," dated May 18, 2012.
- 2. Letter from TVA to NRC, "Request for Extension of Enforcement Discretion Regarding Transition to National Fire Protection Association (NFPA) 805, Performance-Based Standard for Fire Protection for Light Water Reactor Generating Plants, 2001 Edition, for Browns Ferry Nuclear Plant Units 1, 2, and 3," dated March 20, 2012 In accordance with 10 CFR 2.202, TVA submits this response to Confirmatory Order NRC-2012-0117 issued by the NRC and published in the Federal Register on May 29, 2012.
TVA consents to the Order as published in the Federal Register and agrees to comply with the actions and schedule contained therein. This consent constitutes a waiver of TVA's right to request a hearing, findings of fact and conclusions of law, and of all rights to seek Commission and judicial review, or to contest the validity of the Order in any forum as to those matters discussed in the Order. This waiver is consistent with the notification of waiver signed by me on May 16, 2012.
There are no new commitments contained in this letter.
