By letters dated February 28, 2008, May 21, 2008, July 31, 2008, and August 22, 2008, (Agencywide Documents Access and Management System (ADAMS)

Accession Nos. ML080640601, ML081640617, ML082170513, ML082380890 respectively), Southern Nuclear Operating Company (SNC) submitted supplemental responses to Generic Letter (GL) 2004-02, "Potential Impact of Debris Blockage on Emergency Recirculation During Design Basis Accidents at Pressurized Water Reactors," for the Vogtle Electric Generating Plant, Units 1 and 2 (VEGP).

The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed these submittals. Based on these reviews, the NRC staff has determined that additional information is needed in order to conclude there is reasonable assurance that GL 2004-02 has been satisfactorily addressed for VEGP. By letter dated December 2, 2008, the NRC provided SNC a request for additional information (RAI). The NRC requests that the licensee respond to this RAI within 90 days of the date of the letter. In addition, the NRC issued a letter on September 17, 2008 with a request for additional information that outlined concerns with the test protocol using in the VUEZ head loss and chemical effects testing.

SNC submitted a letter on November 7,2008 stating that based on a review of the RAI on the VUEZ testing protocol, SNC has determined the need for an alternate approach to demonstrate adequate performance of the VEGP containment sump strainers. This letter also stated that SNC's closeout of Generic letter 2004-02 would be complete by November 20,2009.

SNC has reviewed the RAI in the December 2, 2008 letter and has concluded that more than 90 days is required to provide a meaningful and comprehensive response. SNC has determined that the majority of the questions asked in this letter will require the alternate approach/test-for-success results discussed in the November 7, 2008 letter. VEGP testing is scheduled for completion by

Nuclear Regulatory Commission NL-09-0159 Page 2 April 30, 2009 and SNC's final submittal (excluding issues related to WCAP 16793-NP, "Evaluation of Long-Term Cooling Considering Particulate, Fibrous, and Chemical Debris in the Recirculating Fluid") to Generic letter 2004-02 would still be complete by November 20,2009. As such, SNC will provide one response to the RAI, once the new testing and analysis is complete, in this final submittal.
