On May 11, 2015, the U.S. Nuclear Regulatory Commission (NRC) issued Regulatory Issue Summary (RIS) 2015-07, "Process for Scheduling and Allocating Resources in FY 2017 for the Review of New Licensing Applications for Large Light-Water Reactors and Small Modular Reactors." This RIS requests that future applicants for a construction permit (CP), standard design certification (DC), early site permit (ESP), combined license (COL), standard design approval (SDA), manufacturing license (ML), or license amendment (LA) submit information related to the expected schedule for submission of, and details related to, any forthcoming applications. The enclosures to this letter provide Southern Nuclear Operating Company's (SNC's) response to RIS 2015-07.
Request for Withholding SNC's response to RIS 2015-07 contains confidential commercial information. Pursuant to 1 0 C.F.R. § 2.390, SNC requests that certain information be withheld from public disclosure. In support of this request for withholding, Enclosure 1 to this letter contains an Affidavit for withholding executed by SNC and prepared in accordance with 10 C.F.R. § 2.390, which specifies the confidential commercial information sought to be withheld and the basis on which the information may be withheld. Enclosure 2 contains the public, redacted version of SNC's RIS 2015-07 response, Enclosure 3 contains the non-public, non-redacted version of SNC's RIS 2015-07 response, and Enclosure 4 contains a Proprietary Information Notice.
SNC requests that Enclosure 3, SNC's non-redacted response to RIS 2015-07 containing confidential commercial information, be withheld from public disclosure under 10 C.F.R. § 2.390.
The redacted version of SNC's RIS 2015-07 response in Enclosure 2 is suitable for public disclosure.

My name is Brian H. Whitley, and I am over the age of 18. I reside in Jefferson County, Alabama. I am employed by Southern Nuclear Operating Company (SNC) as Director of Regulatory Affairs. I am authorized to make this affidavit on behalf of SNC.
- 2.
I have personal knowledge of the criteria and procedures used by SNC to designate information as a trade secret, privileged, or confidential commercial or financial information.
- 3.
In accordance with 10 C.F.R. § 2.390, I am making this Affidavit to support SNCs request for withholding, contained in the letter accompanying this Affidavit. The specific information to be withheld is contained on page 2 of Enclosure 3 (SNCs Response to NRCs RIS 2015-07).
- 4.
The information is sought to be withheld under 10 C.F.R. § 2.390(a)(4), as it is confidential and proprietary commercial information. In support of this request for withholding and pursuant to 10 C.F.R. § 2.390(b)(4), I state the following:
- i. SNC has held the information in confidence.
ii. This information is of a type customarily held in confidence by SNC. SNC is voluntarily submitting this information to the NRC to assist the NRC in determining fiscal year (FY) 2017 resource and budget needs, as requested in RIS 2015-07. RIS 2015-07 states that any response to the information requests contained therein are strictly voluntary.
iii. This information is being transmitted to the NRC in confidence.
iv. This information is not available in public sources.
- v. The public disclosure of the information sought to be withheld is likely to cause substantial harm to SNCs competitive position. The information sought to be withheld contains aspects of SNCs potential commercial plans, the release of
ND-15-1089 Page 4 of 4 which will likely cause harm by allowing other entities to gain a competitive advantage through prior knowledge of SNCs long-term plans.

ND-15-1089 Page 2 of 2 PROPRIETARY INFORMATION NOTICE Transmitted herewith are proprietary and non-proprietary versions of documents furnished to the NRC in connection with the response to RIS 2015-07.
In order to conform to the requirements of 10 C.F.R. § 2.390 of the Commissions regulations concerning the protection of proprietary information submitted to the NRC, the information which is proprietary in the proprietary versions is contained within brackets, and where the proprietary information has been deleted in the non-proprietary versions, only the brackets remain (the information that was contained within the brackets in the proprietary versions having been deleted). The justification for claiming the information so designated as proprietary is indicated in Enclosure 1, Affidavit for Withholding accompanying this transmittal pursuant to 10 C.F.R. § 2.390(b)(1).
