NOTICE OF ISSUANCE OF CONSTRUCTION PERMIT FOR KEMMERER POWER STATION UNIT 1 SITE IN LINCOLN COUNTY, WYOMING (DOCKET NUMBER: 50-613)

Dear Chairman Large:

The purpose of this letter is to inform you that the U.S. Nuclear Regulatory Commission (NRC) staff has issued a construction permit (CP) for advanced reactor No. CPAR-1 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML26034B247) to US SFR Owner, LLC (USO) pursuant to Title 10 of the Code of Federal Regulations (10 CFR) section 50.35, Issuance of construction permits. This CP, which is immediately effective, authorizes USO to construct a Natrium Reactor Plant in Kemmerer, Lincoln County, Wyoming (Kemmerer Power Station Unit 1). This CP construction permit was issued after receiving the report of the Advisory Committee on Reactor Safeguards, dated November 16, 2025, (ML25311A150), and as authorized by the Commissions hearing decision dated March 4, 2026, (ML26063A399).

Issuance of the CP also followed completion of the Section 106 of the National Historic Preservation Act of 1966, as amended (NHPA), process. As described in paragraph 800.8(c) of Title 36 of the Code of Federal Regulations (36 CFR) Part 800the regulations implementing NHPA Section 106the NRC staff used the National Environmental Policy Act of 1969, as amended (NEPA), process to comply with NHPA Section 106 in lieu of the procedures set forth in 36 CFR 800.3 through 800.6. The NRC was the lead Federal agency for the environmental review under NEPA and for NHPA Section 106 consultation, with the U.S. Department of Energy serving as a cooperating agency.

As part of its review, the NRC issued a final environmental impact statement (EIS), NUREG-2268, Environmental Impact Statement for the Construction Permit Application for Kemmerer Power Station Unit 1 (ML25287A017). The final EIS is available via the following link:

The final EIS, Section 3.7, and Appendices B and C, serve as the administrative record of the NRC NHPA Section 106 compliance and consultation. The NRCs determination under Section 106 of the NHPA was that the undertaking will have no adverse effect on historic properties, since the eligible and contributing portions of historic properties within the area of potential effects will be avoided by construction activities. The Wyoming State Historic Preservation Office concurred with this determination by letter dated August 6, 2025, (ML25219A012; see WyoTrack project number DBI_WY_2022_280).

The NRC further determined that while there are no adverse effects on historic properties as part of NHPA Section 106, since construction activities will occur within and immediately adjacent to archaeological site boundaries, there would be a MODERATE impact under NEPA.

As noted in Section 3.7 of the final EIS, the Northern Arapaho Tribe responded to the NRCs request for review of the NHPA Section 106 determination by requesting that a Tribal monitor be present during construction of the parking lot adjacent to and within an archaeological site boundary (ML25251A276). USO plans to involve a Tribal monitor during future construction and will include protection and long-term management of archaeological sites into their environmental management policies for the facility.
