The purpose of my outreach today is to notify you that by letter dated January 29, 2026 (Agencywide Documents and Management System (ADAMS) Accession No. ML26033A182), Governor Mike Braun, on behalf of the State of Indiana, formally requested that an agreement be established with the U.S. Nuclear Regulatory Commission (NRC). Under this agreement, the NRC would discontinue, and the State of Indiana would assume regulatory authority for certain radioactive materials under federal jurisdiction. Governor Braun requested an effective date of October 1, 2026. For your convenience, a copy of the letter is attached:
Indiana Final Application Ltr to NRC.pdf The NRC staff will conduct an assessment of the States Agreement material program (ADAMS Accession No. ML26033A160) to evaluate its adequacy in protecting public health and safety and to determine its compatibility with the NRC materials program in a timely manner.
Information regarding the status of the State of Indiana's request to pursue an agreement with the NRC can be found at:
https://www.nrc.gov/agreement-states/indiana/indiana-agreement-application-process. Should you have questions regarding the NRC Agreement State Program, please contact Senior Intergovernmental Liaison, Sherrie Flaherty at Sherrie.Flaherty@nrc.gov.
The NRC protects public health and safety and advances the nations common defense and security by enabling the safe and secure use and deployment of civilian nuclear energy technologies and radioactive materials through efficient and reliable licensing, oversight, and regulation for the benefit of society and the environment.
