CONCLUSION OF SECTION 106 CONSULTATION AND NOTICE OF AVAILABILITY OF THE ENVIRONMENTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACTREGARDING SUBSEQUENT LICENSE RENEWAL FOR THE EDWIN I. HATCH NUCLEAR PLANT UNIT NOS. 1 AND 2 (DOCKET NUMBERS: 50-321 AND 50-366; (GEORGIA SHPO PROJECT #HP-250825-012 AND HP-231122-009)

The U.S. Nuclear Regulatory Commission (NRC) staff has completed a review of the environmental effects of the proposed subsequent renewal of the renewed facility operating licenses for the Edwin I. Hatch Nuclear Plant Unit Nos. 1 and 2 (Hatch) for an additional 20 years of operation. Hatch is operated by Southern Nuclear Operating Co., Inc. (SNC) and is located in Appling County, Georgia. SNC submitted an application for subsequent license renewal (SLR) by letter dated May 15, 2025, pursuant to Title 10 of the Code of Federal Regulations Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The application is available through the NRCs Agencywide Documents Access and Management System (ADAMS), which is accessible online at https://www.nrc.gov/reading-rm/adams.html, under Package Accession No. ML25135A390. SNCs environmental report included with the SLR application is available under ML25135A392. The current renewed facility operating licenses for Hatch expire on August 6, 2034, and June 13, 2038, respectively.
The purpose of this letter is to provide you notice of the availability of the environmental assessment (EA) and Finding of No Significant Impact (FONSI) (ML26063A016) for the subsequent renewal of the relevant operating licenses and to document the NRCs conclusion of the National Historic Preservation Act of 1966, as amended, (NHPA) Section 106 consultation consistent with Title 36 of the Code of Federal Regulations (36 CFR) Part 800.
By letters dated July 22, 2025, the NRC staff initiated NHPA Section 106 consultation, as appropriate, with nine federally recognized Tribes (ML25192A075), one state recognized Tribe (ML25192A146), the Georgia State Historic Preservation Officer (SHPO), and the Advisory Council on Historic Preservation (ACHP) (ML25192A044) regarding the Hatch SLR. These letters also included a notification of the NRC staffs intent in accordance with 36 CFR 800.8(c) to comply with its obligations under NHPA Section 106 through the National Environmental Policy Act of 1969, as amended, process.

Thereafter, by letters dated February 3, 2026, the NRC staff notified the nine federally recognized and one state recognized Tribes, the Georgia SHPO, and the ACHP, that the Hatch historic and cultural resources section of the EA, which contained the NRC staffs finding of no adverse effect to historic properties, was available for public comment (ML26035A151). The Georgia SHPO concurred with the NRC staffs finding by letter dated March 3, 2026 (ML26063A013). All information on NHPA Section 106 consultation is detailed in the EA.
