On January26, 2026, Florida Power & Light Company (the licensee) submitted slides (non-public ML26026A001) to support a closed meeting with the U.S. Nuclear Regulatory Commission (NRC) staff held on January 27, 2026. The slides were marked as containing confidential and proprietary information belonging to ENERCON. By email dated January28, 2026 (ML26029A311), the NRC staff informed the licensee that the procedures in Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390 for requesting proprietary information to be withheld from public disclosure were not fully followed. On February 6, 2026, the licensee submitted the following:

An affidavit dated February5, 2026, executed by a representative of ENERCON Slides marked as proprietary with portion marking that identified the specific information claimed to be propriety A public version of the slides with the proprietary information redacted

The NRC staff reviewed the affidavit and information provided in the portion-marked slides provided on February5, 2026, in accordance with the requirements of 10CFR2.390. The NRC staff noted that the affidavit incorrectly cites 10 CFR 2.790, but this did not affect the staffs determination. Based on the statements in the affidavit, the staff determined that the information in the portion-marked slides sought to be withheld contains proprietary commercial information and should be withheld from public disclosure. Therefore, the information marked as proprietary will be withheld from public disclosure pursuant to 10CFR 2.390(b)(5).

The NRC may have cause to review this determination in the future. If the NRC makes a determination adverse to the above, the submitter will be notified in advance of any public disclosure.
