Docket No. 50-614-CP ASLBP No. 25-991-01-CP-BD01 February 17, 2026 MEMORANDUM AND ORDER (Granting Joint Motion Regarding Mandatory Disclosures)
On February 13, 2026, applicant Long Mott Energy, LLC and intervenor San Antonio Bay Estuarine Waterkeeper, which currently constitute the parties to this proceeding relative to admitted Contentions 3A and 3B, filed an unopposed joint motion requesting an extension of the deadline to submit initial discovery disclosures associated with those contentions, as well as Board approval of certain revisions to the default disclosure protocols in 10 C.F.R. § 2.336 for this proceeding.1 2 For good cause shown, the parties request to extend the discovery deadline for admitted Contentions 3A and 3B to Wednesday, March 25, 2026, is granted. the parties jointly select an alternative date, the obligation to provide ongoing discovery under section 2.336(d) shall occur on the third Tuesday of each month.
The parties joint agreement to revise or clarify the discovery provisions in section 2.336 is likewise granted. The parties shall continue to work together to resolve any issues arising from their mutual discovery obligations and shall promptly notify the Board of any discovery disputes they are not able to resolve amongst themselves.
As each party and the NRC staff is required to make initial disclosures under section 2.336(c), if the Staff desires to be subject to the discovery deadline and protocols approved by the Board in this issuance, it shall notify the Board in a submission filed on or before February 23, 2026. Absent such notification, the NRC Staff is not bound by any agreement between the parties and the NRC Staffs obligations under section 2.336 remain unchanged.
