NOTICE OF VIOLATION - SABIC INNOVATIVE PLASTICS MT. VERNON, LLC

Dear Gregory Horton:

Between December 12, 2025, and January 29, 2026, an inspector from the U.S. Nuclear Regulatory Commission (NRC) conducted an in-office review of the circumstances surrounding the loss of a generally licensed static eliminator device at your facility in Mt. Vernon, Indiana.

The NRC initiated this review after SABIC Innovative Plastics Mt. Vernon, LLC contacted the NRC Operations Center on December 12, 2025, to report the loss of the static eliminator device and followed that telephone notification with a written report on January 9, 2026. The loss was discovered while preparing to return the device to the manufacturer and it could not be found.

The last known use of the device was in May 2025. An electronic copy of the written report can be found in the NRCs Agencywide Documents Access and Management System (ADAMS) under Accession Number ML26030A287.

During this in-office review, the NRC staff examined activities conducted under your general license related to public health and safety. Additionally, the staff examined your compliance with the Commissions rules and regulations. The in-office review consisted of an interview with the Radiation Safety Officer (RSO) and examination of information provided by you to the NRC.

Based on the results of this review, the NRC has determined that one Severity Level IV violation of NRC requirements occurred. The violation concerned the failure to transfer or dispose of a device containing byproduct material only by export, transfer to another general licensee, or to an authorized specific licensee as required by Title 10 of the Code of Federal Regulations (10 CFR) Part 31.5(c)(8)(i). The violation was evaluated in accordance with the NRC Enforcement Policy, available on the NRCs website at http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html. The violation is cited in the enclosed Notice of Violation (Notice) (Enclosure 1). The NRC is citing the violation in the enclosed Notice because it was revealed through an event (Event Notification58080).

The root cause of the violation was determined to be inadequate inventory control. The licensee was preparing to return the device to the manufacturer as the work processes and department that used the static eliminator are to be eliminated. The licensee has no plans to acquire February 24, 2026

additional radioactive material. Based on information in the Sealed Source and Device Registry and assuming a simple linear relationship between activity and exposure rates across the varying activities used in the model, the exposure rate on contact would be approximately 50 µR/hr. This is 2.5% of the public dose limit of 2 mR in any one hour and would take 2000 hours0.0231 days <br />0.556 hours <br />0.00331 weeks <br />7.61e-4 months <br /> of contact for an individual to receive the annual limit of 100 mR. However, the licensee believes that the device is still inside a locked building and not accessible to members of the public.

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence, and the date when full compliance will be achieved is already adequately addressed on the docket in this letter and in additional correspondence. Therefore, you are not required to respond to this letter unless the description herein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in the enclosed Notice.

Vernon, IN under 10 CFR 31.5 Docket No. 999-90003 EAF-RIII-2026-0012 During a U.S. Nuclear Regulatory Commission (NRC) in-office review of Event Number 58080 conducted on December 12, 2025 through January 30, 2026, one violation of NRC requirements was identified. In accordance with the NRC Enforcement Policy, the violation is listed below:

Title 10 of the Code of Federal Regulations (10 CFR) Part 31.5(c)(8)(i) requires, in part, that any person who acquires, receives, possesses, uses or transfers byproduct material in a device pursuant to a general license shall transfer or dispose of the device containing byproduct material only by export as provided by 10 CFR 31.5(c)(7), by transfer to another general licensee as authorized in 10 CFR 31.5(c)(9), or to a person authorized to receive the device by a specific license issued under parts 30 and 32 of this chapter, or part 30 of this chapter that authorizes waste collection, or equivalent regulations of an Agreement State.

Contrary to the above, between May 2025 and December 10, 2025, the licensee failed to transfer or dispose of a device containing byproduct material only by export, transfer to another general licensee, or to a person authorized to receive the device by a specific license, a specific license that authorizes waste collection, or equivalent regulations of an Agreement State. Specifically, the licensee lost a Nuclecel Ionizer static eliminator device (Model: P-2021-8001 SN: A2NJ342 Lease: 083488 from NRD, LLC) containing 10 mCi of Polonium-210.

This is a Severity Level IV violation (NRC Enforcement Policy Section 6.3).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence, and the date when full compliance was achieved, is already adequately addressed on the docket in this letter and in additional correspondence. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a "Reply to a Notice of Violation" and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001 with a copy to the Regional Administrator, Region III, within 30 days of the date of the letter transmitting this Notice.

Alternatively, you may provide a response electronically to RidsRgn3DRSS.Resource@nrc.gov within 30 days of the date of this letter.
