Subject:

Request for Rescission of Exemptions from 10 CFR 50.54(w)(1), Concerning On-Site Property Damage Insurance, and 10 CFR 140.11 (a)(4), Concerning Primary and Secondary Liability Insurance On September 20, 2019, Three Mile Island, Unit 1 (TMI-1), was shut down due to market conditions. In a letter to NRC, dated November 25, 2019, Exelon Generation Company, LLC (Exelon) requested an exemption from 10 CFR 50.54(w)(1) concerning on-site property damage insurance (Reference 1). This request was approved by NRC, and the exemption was issued on March 19, 2021 (Reference 2). Additionally, in a letter to NRC, dated January 3, 2020, Exelon requested an exemption from 10 CFR 140.11(a)(4) concerning primary offsite liability insurance and secondary liability insurance for TMI-1 (Reference 3). This request was approved by NRC, and the exemption was issued on March 9, 2021 (Reference 4).

On September 20, 2024, Constellation Energy Generation, LLC (CEG) announced its intention to restart TMI-1 and to change the facilitys name to the Christopher M. Crane Clean Energy Center (CCEC) (Reference 5). Subsequently, on November 4, 2024, CEG submitted the Regulatory Path to Reauthorize Power Operations (Reference 6). In that submittal, CEG described the approach to restoration of the Operating Reactor License Basis (ORLB). Furthermore, on November 19, 2024, CEG submitted its Request for Exemption from Certain Termination of License Requirements of 10 CFR 50.82 (Reference 7), which, if approved, will allow placing fuel into the reactor and the subsequent return to power operations.

In Reference 6, CEG stated that it would request rescission of NRC-approved decommissioning-related exemptions as part of the CCEC transition out of decommissioning. This letter formally provides CEGs request for NRC to rescind the exemption from 10 CFR 50.54(w)(1), concerning on-site property damage insurance, which was approved in reference 2, and the exemption from 10 CFR 140.11(a)(4), which was approved in reference 4. CEG has been working with both American Nuclear Insurers and Nuclear Electric Insurance Limited to ensure that the primary liability limit and secondary financial protection, as well as onsite property insurance protections, are restored, consistent with NRC requirements, and that both bodies are prepared to issue the necessary endorsements and policy changes at the appropriate time.
