ISSUANCE OF EXEMPTION FOR BIG ROCK POINT INDEPENDENT SPENT FUEL STORAGE INSTALLATION REGARDING ANNUAL RADIOACTIVE EFFLUENT RELEASE REPORT

Dear Mr. Noval:

By letter dated June 30, 2025 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML25181A014), Holtec Decommissioning International, LLC (HDI),

submitted a request to the U.S. Nuclear Regulatory Commission (NRC) for an exemption from Title 10 of the Code of Federal Regulations (10 CFR) 72.212 (a)(2), (b)(2), (b)(3), (b)(4),

(B)(5)(i), (b)(11), and 72.214 for Big Rock Point (BRP) Independent Spent Fuel Storage Installation (ISFSI) Annual Radioactive Effluent Release Report (ARERR). In particular, the exemption request, if approved, would allow BRP to deviate from the requirements in renewed Certificate of Compliance (CoC) No. 1026, Amendment No. 4 (ML24141A272), appendix A, technical specifications (TS), for the FuelSolutionsTM Storage System, section 5.3.4, Radioactive Effluent Control Program, subsection 5.3.4.3, related to the timing of submission for its ARERR.

The 10 CFR 72.212 requirements mentioned above identify that HDI must follow the respective CoC TS for the specific spent fuel casks it uses. Relevant cask TS requires HDI to submit an ARERR for the BRP ISFSI to the NRC in accordance with 10 CFR 72.44(d)(3), which requires a report submittal within 60 days after the end of the 12-month monitoring period. The BRPs 12-month monitoring period is effective from January 1 to December 31 of each year. Hence, BRP is required to submit the effluent monitoring report prior to March 1 of each year.

In its June 30, 2025, letter, HDI requested relief regarding the 60-day reporting requirement, so that the annual liquid and gaseous effluent release report for the BRP ISFSI be incorporated into, and submitted with, the BRP Plant site ARERR on or before May 1 rather than on or before March 1, of each year to align with the submittal of its ARERR as required by the BRP Plant Renewed Facility Operating License, DPR-6, Defueled Technical Specifications (DTS)

The NRC staff reviewed HDIs exemption request for the BRP ISFSI. A summary of the NRC staffs review is included in the enclosed safety evaluation report.

Based on the staffs evaluation, the NRC has determined that, pursuant to 10 CFR 72.7, Specific Exemptions, the exemption is authorized by law, will not endanger life or property or the common defense and security, and is otherwise in the public interest. Accordingly, the NRC grants HDI an exemption from 10 CFR 72.212(a)(2), (b)(2), (b)(3), (b)(4), (b)(5)(i), (b)(11), and 72.214. The exemption is effective immediately upon issuance. This exemption allows HDI to submit the annual liquid and gaseous effluent release report for the BRP ISFSI on or before May 1, of each year, to align with its submittal of the ARERR as required by the BRP Plant Renewed Facility Operating License No. DPR-6, DTS section 6.0, "Administrative Controls,"

section 6.6.3, Annual Radioactive Effluent Release Report. All other requirements of 10 CFR 72.212(a)(2), (b)(2), (b)(3), (b)(4), (b)(5)(i), (b)(11), and 72.214 shall be met.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the publicly available records component of the NRCs document system, ADAMS.
