UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 Mr. Patrick Mulligan Conference of Radiation Control Program Directors 1030 Burlington Lane, Suite 4B Frankfort, KY 406010

Dear Mr. Mulligan:

February 26, 2026 Thank you for your letter dated January 22, 2026, providing comments about the U.S.

Nuclear Regulatory Commission's (NRC's) ongoing evaluation of the Linear No-Threshold (LNT) model and the as low as reasonably achievable (ALARA) principle pursuant to Executive Order (EO) 14300.

Pursuant to EO 14215, "Ensuring Accountability for All Agencies," the NRC's rulemaking efforts are now subject to EO 12866, "Regulatory Planning and Review," which means that how and when the NRC engages stakeholders is different from the past. In implementing these new directives, the agency is guided by Office of Management and Budget Memorandum M-25-24, "Interim Guidance Implementing Section 3 of EO 14215, Titled "Ensuring Accountability for All Agencies." As a result, NRC rulemakings, including those related to LNT/ALARA, are currently nonpublic. You may visit the NRC's public website here for all publicly available details on the LNT/ALARA rulemaking, including an estimated publication schedule. Once the NRC publishes the draft rules in the Federal Register, the agency will conduct a public comment period during which you will be able to submit written comments, and you are encouraged to do so. Please note that the available information may change as the NRC's efforts progress.

The NRC values our long-standing relationship with the Conference of Radiation Control Program Directors, Inc., and looks forward to your continued engagement on this and many other topics. Please contact Dafna Silberfeld at Dafna.Silberfeld@nrc.gov with any additional questions.

Sincerely, Ho K. Nieh
