Dear Jason Mickelson:

I am writing to acknowledge receipt of your application, dated December 9, 2025, regarding the application of Alternative Soil Standards for the Dawn Mining Company Uranium Millsite in Washington.

Pursuant to the Atomic Energy Act and regulations promulgated thereunder, the NRC is charged with review and approval of any alternative soil standards prior to the State of Washington proceeding with the mill license termination process. NRC approval of the proposed Dawn Mining alternative standards is a regulatory prerequisite to the termination of Washington Materials License No. WN-1043-2, (Amendment 38).

In addition, the NRC must determine that all applicable standards, including any alternative standards, have been met prior to Washington proceeding with the license termination. This will involve NRC review of Washingtons determination as presented to NRC (See procedure, SA-900, Termination of Uranium Milling Licenses in Agreement States, at https://www.nrc.gov/reading-rm/doc-collections/nmss-procedures/state-agreement).

The NRC staff is currently reviewing the alternative soil standards proposed by Dawn Mining Company, agreed to and submitted to NRC by the State of Washington. NRC staff have begun preparing an evaluation that will be provided to the Commission for review and approval after publication for public comment. Following the public comment period, the NRC will evaluate the comments received and develop a final recommendation on the alternative standards for Commission consideration. The Commissions decision will be published in the Federal Register.

It is anticipated that the proposed alternative standards will be presented to the Commission later in 2026.
