Enclosure 2: Affidavit Supporting Request for Withholding from Public Disclosure (10 CFR 2.390)
I, Ashby Bridges, VP of Nuclear Engineering for General Matter, Inc. (General Matter) do hereby affirm and state:
- 1. I am authorized to execute this affidavit on behalf of General Matter. I am further authorized to review information submitted to or discussed with the U.S. Nuclear Regulatory Commission (NRC) and apply for the withholding of information from disclosure. The purpose of this affidavit is to provide the information required by 10 CFR 2.390(b) in support of General Matters request for proprietary treatment of certain commercial information submitted in General Matters letter GEM-LIC-2026-001s Enclosure 1.
- 2. I have knowledge of the criteria used by General Matter in designating information as sensitive, proprietary, confidential, and export-controlled.
- 3. Pursuant to the provision of paragraph (b)(4) of 10 CFR 2.390, the following is furnished for consideration by the NRC in determining whether the information sought to be withheld from public disclosure should be withheld.
- a. The information sought to be withheld from public disclosure in Enclosure 1 is owned by and has been held in confidence by General Matter.
- b. This information was prepared for and transmitted to the Nuclear Regulatory Commission with the explicit understanding that the information itself would be treated as proprietary and confidential.
- c. The information is proprietary to General Matter and is not available to the public or in any public sources.
- d. The information is of a type customarily held in confidence given the proprietary, competitive nature of the information.
- e. The information contains planned activities of GeM related to the development of the commercialization strategy for our novel technology.
Public disclosure of the information would create substantial harm to GeM because it would reveal valuable licensing and construction strategy and timeline information. Its use by a competitor could substantially improve the competitors position in the design, manufacture, licensing, construction, or operation of a similar competing product. Years of cumulative effort have gone into the work supporting this content, and given the innovative and differentiated insights generated by the work, others would need to expend great effort to duplicate the information. This information cannot be acquired elsewhere.
- f. The Proprietary Information is transmitted to the NRC in confidence and under the provisions of 10 CFR 2.390; it is to be received in confidence by the NRC. The information is properly marked as the following: Proprietary -
