At the request of the consulting Tribe, their comment letter dated December 22, 2025, regarding the NRCs draft Supplemental Environmental Impact Statement (SEIS) and Section 106 determinations for the Clinch River Construction Permit review has been designated as non-public in accordance with government-to-government confidentiality provisions. The Tribes Tribal Historic Preservation Officer has reviewed and approved the following public summary:
By letter dated December 22, 2025, one Federally recognized Indian Tribe provided comments on the draft SEIS and Section 106 determinations by finding no objection to the project proceeding, as long as: 1) sensitive areas with site 40RE108 are avoided and protected, 2) the NRC contacts the Indian Tribe if any changes to activities within or the scope of the APE may occur, 3) the project stops work and contacts the Indian Tribe if items of cultural significance are discovered during the course of the project, and 4) that the NRC conduct inquires with other historic preservation offices regarding historic properties not included in the Indian Tribes database and records.
