PART I.B -- INFORMATION NOT LOCATED OR WITHHELD FROM DISCLOSURE We did not locate any agency records responsive to your request. Note: Agencies may treat three discrete categories of law enforcement and national security records as not subject to the FOIA ("exclusions"). See 5 U.S.C. 552(c). This is a standard notification given to all requesters; it should not be taken to mean that any excluded records do, or do not, exist.

We have withheld certain information pursuant to the FOIA exemptions described, and for the reasons stated, in Part II.

For SECY-03-0050, the NRC coordinated with the Executive Office of the President, Office of Science and Technology Policy (OSTP). Pursuant to the FOIA and OSTP regulations, a requester may submit a written appeal contesting any adverse determination. Any appeal related to OSTPs processing of the requested records must either be sent: 1) via e-mail to OSTPFOIA@ostp.eop.gov; or 2) by mail to Chief FOIA Officer, Office of Science and Technology Policy, Eisenhower Executive Office Building, 1650 Pennsylvania Ave., NW., Washington, DC 20504. In the appeal letter, please reference OSTP Control Number: 25-048C. To expedite the appellate process and give the requester an opportunity to present his or her arguments, the notice should contain a brief statement of the reason(s) why the requester believes the adverse determination to be in error. Any appeal must be sent to one of the above listed addresses no later than ninety (90) calendar days from the date of this letter. Finally, requesters also have the right to seek dispute resolution services from OSTPs FOIA Public Liaison or the Office of Government Information Services (hereafter OGIS).
