SL-XEN-2026-002 Reports with Proprietary Markings.pdf Hi Milton, I just had a conversation with Julie Ezell, our attorney assigned to the project.
Julie has informed me that the Sargent & Lundy letter allows X-energy to release the report to us, but it does not address whether the NRC can release the report to the public. In other words, releasing the report to the NRC may mean keeping these documents withheld from public disclosure.
If the report can be made public, then we would need a letter to that effect.
If the report must be withheld from the public as proprietary/confidential then we would evaluate it under 10CFR 2.390. Generally, an applicant would submit two versions of the same document, one proprietary/confidential (non-public) and the other public. NRC is still withholding the report from the public.
Julie is available if we need to have an attorney to attorney consult here. Perhaps that is something we can discuss Monday afternoon at our meeting.

[External_Sender] The Ecological Resources Technical Report Joe, Attached is a letter from our contractor releasing the Ecological Resources Technical Report from proprietary and confidentiality restrictions.
We are also releasing the Demographic Study and a Technical Memo regarding the rationale for establishment of a focused region of influence for use in socioeconomics analysis from proprietary and confidentiality restrictions, should it become necessary to make them public.
These two documents are identified in the attached letter.
