REVISIONS TO INDIANA REGULATIONS 290 IAC 3-1 THROUGH 3-18
Dear Courtney Eckstein:
The U.S. Nuclear Regulatory Commission (NRC) has reviewed the revisions to Indiana regulations 290 IAC 3-1 through 3-18, received by our office on December 5, 2025. Our review identified that the revisions do not address our comments provided to you in a letter dated April 7, 2025 (ML25049A263). However, we note that because the comments are relatively minor, they would not need to be addressed prior to the effective date of Indianas Agreement.
We request that, in your final application, you commit to incorporate the changes from the April 7, 2025, letter the next time you open your regulations for rulemaking. Of note, one of the comments identified in the letter is related to compatibility. The remaining 14 comments are editorial comments that are not necessary for compatibility but should be addressed during the States next rulemaking. We request that when you revise your regulations, a copy of the as published regulations be provided to us for review. As requested in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-201, Review of State Regulatory Requirements, please identify the location of any changes made using a tracked changes or similar format and provide a copy to the Division of Materials Safety, Security, State, and Tribal Programs, NMSS.
