In response to NRC Staffs December 3, 2025 Notification Regarding Supplemental Information,1 the Licensing Board seeks to clarify and provide guidance on the scope of the December 8, 2025 initial prehearing conference. In the notice, the NRC Staff advised the Board that based on supplemental information it had received from applicant Long Mott Energy, L.L.C.
(LME) on September 26, October 17, 2025, and November 20, 2025, the NRC Staff had altered its position on the admissibility of certain contentions.2 The NRC Staff indicated that this supplemental information had cured what it had previously determined were information deficits that rendered portions of two of petitioner San Antonio Bay Estuarine Waterkeepers (Petitioner) contentions admissible contentions of omission, i.e., Contention 1 as it concerned descriptions 1 Notification Regarding Supplemental Information (Dec. 3, 2025).

of fuel qualification and testing to meet 10 C.F.R. § 50.34(a)(8), and Contention 4 regarding the environmental effects of continued storage of spent nuclear fuel and flood level information in LMEs preliminary safety analysis report (PSAR).3 The NRC Staff took no position on whether the supplemental information itself was sufficient to meet regulatory requirements.4 Relative to the contention admissibility impact of the September 26, 2025 LME supplemental information on a portion of Contention 1 and the October 17 and November 20, 2025 LME supplemental information on portions of Contention 4, the Board may ask the participants their views on whether the supplemental information referenced in these LME supplements moots any assertions that the construction application omitted certain required information.5 Additionally, the Board may inquire if Petitioner intends to file one or more new or amended contentions regarding LMEs September 26, October 17, and November 20 information supplements. The argument will not extend to the admissibility or substance of any new or amended contentions that Petitioner may raise.
