PUBLIC ACCESS TO MATERIAL THE NRC SEEKS TO INCORPORATE BY REFERENCE INTO ITS REGULATIONS

Dear Mr. Sowder:

The purpose of this letter is to request that the American Nuclear Society (ANS) provide limited public access to American National Standards Institute/American Nuclear Society (ANSI/ANS)-

6.1.1-2020, Photon and Neutron Fluence-to-Dose Conversion Coefficients, during the public comment period for the U.S. Nuclear Regulatory Commissions (NRCs) proposed rule related to Title 10 of the Code of Federal Regulations (CFR) Part 20, Standards for Protection Against Radiation.

In the near future, the NRC plans to publish in the Federal Register a proposed rule to incorporate by reference (IBR) ANSI/ANS-6.1.1-2020 for use as an acceptable alternative in meeting certain NRC requirements. We are requesting that ANS provide members of the general public with free, read-only access to ANSI/ANS-6.1.1-2020 during the comment period for the proposed rule, which is anticipated early in calendar year 2026. The NRC is not asking your organization to waive its intellectual property rights to these materials. Nor does the NRC seek to undermine or impair your organization's business model with respect to the development and publication of this standard. The NRC recognizes the value of your organization's efforts to develop and update standards such as ANSI/ANS 6.1.1-2020. Reliance on this standard substantially reduces the resources and time it would otherwise take for the NRC to review and approve radiological shielding-related aspects of licensing applications from nuclear power plant licensees and applicants. Additionally, including ANSI/ANS 6.1.1-2020 as an approved methodology within our regulations through the IBR process allows our licensees and applicants to reference the standard without the need to request a specific NRC approval. Accordingly, this inclusion would save resources in the application process for new nuclear facilities and contribute to supporting national policy objectives associated with nuclear energy development.

ANSI/ANSs fulfilment of this request will help the NRC satisfy the Office of the Federal Register requirements in 1 CFR Part 51 regarding agency requests for approval to IBR standards into the Code of Federal Regulations.

The NRC requests that you respond within 30 days of receiving this letter; your prompt reply is required to support the rulemaking schedule for the upcoming revision to 10 CFR Part 20.
