Request to Become a National Environmental Policy Act Cooperating Agency with Respect to the Subsequent License Renewal for the Edwin I. Hatch Nuclear Plant Project

Dear Mr. Koenick:

In accordance with the Memorandum of Understanding (MOU) between the U.S. Department of Energy, Loan Programs Office (DOE LPO) and the U.S. Nuclear Regulatory Commission (NRC)1, DOE LPO is requesting to become a National Environmental Policy Act (NEPA) cooperating agency on the environmental review of the proposed subsequent license renewal (SLR) request for the continued power operations at Edwin I. Hatch Nuclear Plant located in Baxley, Georgia, which is majority owned by Georgia Power Company and operated by Southern Nuclear. NRC will be the lead Federal agency and DOE LPO will be a cooperating agency under NEPA.

The MOU established a framework for the NRC and DOE LPO to efficiently coordinate their respective NEPA responsibilities while assuring that the NRC remains independent of activities involved in DOE LPOs review of projects that may receive Federal financial support.

Cooperation between the NRC and the DOE LPO on the Edwin I. Hatch Nuclear Plant project will ensure that each agencys review responsibilities under NEPA and other related statues are met in connection with their respective jurisdictions. The general roles and responsibilities of the NRC (as lead agency) and the DOE LPO (as cooperating agency) in developing the environmental review pursuant to NEPA for the proposed project are provided in the MOU.
