SUBJECT:

Request to Become a National Environmental Policy Act Cooperating Agency on the Constellation Energy Generation LLC, Resumption of Power Operations at the Christopher M.

Crane Clean Energy Center Project, Dauphin County, Pennsylvania

Dear Mr. Koenick:

In accordance with the Memorandum of Understanding (MOU) between the U.S. Department of Energy, Loan Programs Office (DOE LPO) and the U.S. Nuclear Regulatory Commission (NRC)1, DOE LPO is requesting to become a National Environmental Policy Act (NEPA) cooperating agency on the environmental review of the Constellation Energy Generation LLC, proposed exemption and associated license amendment requests for the reauthorization of power operations at Crane Clean Energy Center located in in Dauphin County, Pennsylvania. NRC will be the lead Federal agency and DOE LPO will be a cooperating agency under NEPA.

The MOU established a framework for the NRC and DOE LPO to efficiently coordinate their respective NEPA responsibilities while assuring that the NRC remains independent of activities involved in DOE LPOs review of projects that may receive Federal financial support.

Cooperation between the NRC and the DOE LPO on the Crane Clean Energy Center resumption of power operations project will ensure that each agencys review responsibilities under NEPA and other related statutes are met in connection with their respective jurisdictions. The general roles and responsibilities of the NRC (as lead agency) and the DOE LPO (as cooperating agency) in developing the EA for the proposed project are provided in the MOU.

1 Memorandum of Understanding between the U.S. Department of Energy, Loan Programs Office and the U.S.

Nuclear Regulatory Commission on Nuclear Energy Projects Under Review by the U.S. Nuclear Regulatory Commission and Seeking Federal Financial Assistance from the Loan Programs Office, executed on June 7, 2024.

2 We look forward to working with the NRC on its environmental review process. If you have any questions or would like to discuss this matter in more detail, please contact Alicia Williamson in the DOE Loan Programs Office at 202-586-7272 or CraneRestart@hq.doe.gov.
