The lapse in government funds, which commenced October 1, 2025, terminated when the President signed a Continuing Resolution on November 12, 2025, at approximately 10:25 p.m. Eastern. During the lapse in appropriations, two relevant submissions were made by the participants in this proceeding. The first was a \

September 30, 2025 letter from Holtec Palisades (Holtec) to the NRC regarding Supplemental Information to License Amendment Request to Change the Full Compliance Implementation Date for the Fire Protection Program Transition License Condition for Required Modifications (ADAMS Accession No. ML25274A074) docketed by the NRC on October 1, 2025, and the second was Joint Petitioners Motion for Leave to File Supplemental Petition and for Alternative Procedural Relief (Motion) (ADAMS Accession No. ML25305A001) filed November 1, 2025. In the Motion, Joint Petitioners seek leave to file a supplemental petition purportedly in response to Holtecs above-referenced supplemental information filing.1 In light of the Notice issued on behalf of the Commission by the Office of the Secretary 1

on October 1, 2025, and after consideration of the submissions referenced above, the Board enters the following Order:

Answers (as succinct as possible) by Holtec and the NRC Staff to the Joint Petitioners Consolidated Petition of September 7, 2025, are due by end of day Wednesday, November 26, 2025.

One consolidated Reply by Joint Petitioners, limited to 50 pages and targeted to only new argument(s) or fact(s) in the Answers, is due by end of day Friday, December 5, 2025, given the intervening Thanksgiving holiday.

The participants shall consult and file not later than Friday, November 21, 2025, a Joint Notice advising of their collective availability for in-person oral argument in the Boards Hearing Room on the following dates: December 8-11 and 16-19, 2025. After reviewing the Answers and Reply submissions, the Board will determine whether oral argument is needed and will advise the participants as expeditiously as possible. If oral argument is held, it will be limited to issues in the Consolidated Petition, Answers thereto, and Reply thereto; it will not address issues in the motion for leave or related submissions (see below).

Joint Petitioners November 1, 2025 Motion is denied without prejudice to refiling as noted below.

In compliance with the Commissions October 1, 2025 Notice referenced above, Joint Petitioners are given until December 15, 2025, to file a motion for leave to file new or amended contentions in light of Holtecs \

September 30, 2025 letter.

o The motion is limited to 15 pages and must address the requirements of 10 C.F.R. § 2.309(c).

o Joint Petitioners also must include as an attachment to their motion their proposed new or amended contentions, which are limited to 50 pages and must be limited solely to contentions arising due to the purportedly new information in Holtecs \

September 30, 2025 letter.

Holtec and the NRC Staff each are given until January 16, 2026 (due to the intervening Christmas and New Years holidays), to file an answer to the motion for leave to file.

o Each answer is limited to 15 pages.

o Each answer must include as an attachment an answer (not to exceed 40 pages) to the proposed new or amended contentions that Joint Petitioners attach to their motion for leave.

Joint Petitioners are given until January 23, 2026, to file a single reply in support of their motion for leave.

o The reply in support of the motion for leave is limited to 10 pages.

o The Joint Petitioners must include, as an attachment to their reply, a reply (not to exceed 20 pages) in support of their proposed new or amended contentions. That reply in support of their proposed new or amended contentions shall be targeted to only new argument(s) or fact(s) in the answers of Holtec and the NRC Staff.

The Board denies as moot the Joint Motion Requesting Revised Briefing Schedule, filed November 13, 2025.
