ACCEPTANCE FOR DOCKETING OF THE FERMI AMERICA, DONALD J TRUMP ADVANCED ENERGY AND INTELLIGENCE CAMPUS COMBINED OPERATING LICENSE APPLICATION PARTS 1 AND 2
Dear Dr. Donaghy,
By letters to the U.S. Nuclear Regulatory Commission (NRC) dated June 17, 2025, and August 20, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25169A394 and ML25232A199, respectively), Fermi America, Donald J. Trump Advanced Energy and Intelligence Campus, submitted Parts 1 and 2 of the Combined Operating License Application (COLA) for a 4-unit power reactor facility pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants.
Per the Memorandum of Understanding (MOU) between the Department of Homeland Security (DHS) and the NRC, dated December 19, 2011 (ADAMS No. ML113550508) before issuing a license for a utilization facility, the NRC will request that DHS Cybersecurity and Infrastructure Security Agency (CISA), review and provide to the NRC comments on the vulnerabilities of the location of the proposed facility to a potential terrorist attack. Part 3 of the application, which will include Part 6 (Security Plans) and the FSAR Chapter 13, Conduct of Operations, has not yet been submitted, nor has it been accepted for docketing. Accordingly, at your discretion, CISA may either begin the consultation process at this time or wait until Part 3 is submitted and accepted.
The NRC anticipates receiving the information contained in Part 3 toward the end of the calendar year 2026, at which point the consultation under the MOU between our agencies could begin.
