RESPONSE LETTER TO THE PRAIRIE ISLAND INDIAN COMMUNITY CONSULTATION REQUEST REGARDING EXECUTIVE ORDER 14300, ORDERING THE REFORM OF THE NUCLEAR REGULATORY COMMISSION, SECTION 5(8)

Dear President Johnson:

Thank you for your letter dated July 31, 2025 (Agencywide Documents Access and Management System No. ML25255A118), requesting consultation on Section 5(b) of Executive Order (EO) 14300. The U.S. Nuclear Regulatory Commission (NRC) staff appreciates the Prairie Island Indian Community's continued engagement and commitment to ensuring that Tribal interests are considered in federal regulatory processes.

Consistent with the Commission's Tribal Policy Statement, we carefully reviewed your request and thoroughly evaluated its feasibility, considering the nature of the activity, timing constraints, and other relevant factors. The NRC staff determined that formal consultation is not appropriate, because the relevant information remains pre-decisional and is not yet substantively developed to support meaningful consultation.

We recognize the importance of maintaining open and respectful communication with Tribal governments. As outlined in the NRC's Tribal Policy Statement, the agency is committed to conducting outreach to keep Indian Tribes informed of our actions and plans, as appropriate.

For example, on December 10, 2025, the NRC staff held a virtual government-to-government meeting to provide an overview of rulemaking activities related to the EO 14300 and to offer Tribal representatives an opportunity to engage directly with NRC staff, ask questions, and share perspectives. In addition, the NRC has established a website at https://www.nrc.gov/about-nrc/governing-laws/advance-act, which Indian Tribes may use to find information related to the implementation of EO 14300 and NRC reform efforts.
