RESPONSE TO THE NUCLEAR ENERGY INSTITUTES REQUEST FOR A RETRACTION OF CHARGES RELATED TO THE REQUEST FOR ENDORSEMENT AND FEE EXEMPTION FOR NEI 22-04, REVISION 0, "UTILIZATION OF ISO 9001 AND OTHER NON-NUCLEAR SUPPLIERS FOR SAFETY-RELATED APPLICATIONS
Dear Dr. Richter:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your concerns regarding the retraction of charges related to the request for endorsement and fee exemption for NEI 22-04, Revision 0, "Utilization of ISO 9001 and Other Non-nuclear Suppliers for Safety-related Applications. You have expressed concerns regarding a Part 170 Invoice (No. 25-3655) for the period: 03/23/2025 - 06/28/2025 in the amount of $9,034.50 for Nuclear Energy Institute (NEI) interactions related to the subject submittal. Additionally, you noted that NEI disputes these charges and requests these charges be retracted due to the fee waiver granted.
After reviewing the Part 170 Invoice (No. 25-3655) for the period: 03/23/2025 - 06/28/2025 in the amount of $9,034.50, we have determined NEI does not need to pay this invoice as all charges on the invoice are associated with NRCs review of NEI 22-04, Revision 0, for which NEI has been granted a fee waiver. The subject invoice has been placed in dispute and will be cancelled out in the October timeframe per our internal invoice processes.
Should a future fee waiver be granted concurrent with Part 170 invoicing activities, please contact the Fee Billing Team directly by emailing Fees_Part170External.Resource@nrc.gov to discuss outstanding charges related to the granted fee exemption. Alternatively, in accordance with §170.51, "Right to review and appeal of Prescribed Fees," of Title 10 of the Code of Federal Regulations, NEI can submit NRC Form 527, REQUEST FOR INFORMATION RELATED TO FEES-FOR-SERVICE, as a request for reviewing Part 170 invoice charges.
