REQUEST FOR WITHHOLDING PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE FOR THE LONG MOTT GENERATING STATION CONSTRUCTION PERMIT APPLICATION PART VII
Dear Mr. Feltner:
By letter dated August 4, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25216A265), Long Mott Energy, LLC (LME) submitted an administrative update to add proprietary markings to Part VII of the construction permit application (CPA) for Long Mott Generating Station (LMGS) titled Security-Related Information to be Withheld per 10 CFR 2.390(d)(1). The accompanying affidavit was executed by Mr.
Stephen Vaughn of X Energy, LLC (X-energy) requesting the NRC to withhold the information from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR)
Section 2.390, Public inspections, exemptions, requests for withholding. In addition, the letter included a request that an earlier version of this document submitted on July 17, 2025, be withdrawn from Commission consideration as provided for in 10 CFR 2.390(c)(3). The NRC granted your request after determining that the July document did not meet any of the criteria in 10 CFR 2.390(c)(3)(i)-(v) for retention and, as such, it was removed from ADAMS.
The affidavit states that the submitted information should be considered exempt from mandatory public disclosure because public disclosure of this non-public information is likely to cause substantial harm to the competitive position of X-energy, because it would enhance the ability of competitors to provide similar products and services by reducing their expenditure of resources using similar project methods, equipment testing approach, contractors, or licensing approaches.
The NRC has reviewed the affidavit and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection will not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the NRC staff may send copies of the information to our consultants working in this area. The NRC staff will ensure that the consultants have signed the appropriate agreements for handling proprietary information.

Feltner If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, LME and X-energy should promptly notify the NRC. LME and X-energy also should understand that the NRC staff may have cause to review this determination in the future if, for example, the scope of a Freedom of Information Act request includes this information. In all review situations, if the NRC makes a determination adverse to the above, the owner of the information will be notified in advance of any public disclosure.
