UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 The Honorable Cynthia M. Lummis United States Senate Washington, DC 20510

Dear Senator Lummis:

September 2, 2025 On behalf of the U.S. Nuclear Regulatory Commission (NRC), thank you for your letter dated August 8, 2025, regarding the NRC's role in enabling the deployment of innovative technology to help remediate abandoned uranium mines (AUM). Specifically, your letter acknowledges the Commission's efforts to regulate AUM remediation under the service-provider, source material licensing framework and encourages the NRC to adopt a clear regulatory approach that avoids the imposition of unnecessary regulatory burden.

The NRC agrees with this need for a clear regulatory approach to AUM remediation licensing and we believe the licensing framework we have developed to license DISA Technologies provides a clear regulatory approach without imposing unnecessary regulatory burden. The NRC staff is on schedule to complete its licensing review of the DISA Technologies license application in September 2025, and the Commission is steadfast in its commitment to licensing such remediation technologies in an efficient manner while ensuring safety.

Thank you again for taking the time to express your thoughts and concerns, and for your continuing interest in AUM remediation. If you have any questions or need additional information, please contact me or have your staff contact Eugene Dacus, Director of the Office of Congressional Affairs, at (301) 415-1776.
