SUMMARY

OF THE JUNE 25, 2025, PUBLIC MEETING FOR NUCLEAR ENERGY INSTITUTE TO PRESENT PROPOSED FRAMEWORK FOR FUTURE LICENSEES TO USE AMERICAN SOCIETY OF MECHANICAL ENGINEERS CODE CASE N-883 COMPONENTS (PROJECT NO. 99902028)

The U.S. Nuclear Regulatory Commission (NRC) conducted an Observation public meeting on June 25, 2025, where the Nuclear Energy Institute (NEI) representatives presented a proposed framework for future licensees to use components fabricated under American Society of Mechanical Engineers (ASME) Code Case (CC) N-883: Construction of Items Prior to the Establishment of a Section III, Division 1, Owner. In coordination with NEI, ASME representatives made part of the presentation. There was no closed session for this meeting.

The NEI presentation can be found at the NRCs Agencywide Documents Access and Management System (ADAMS) Accession No. ML25174A125.

The presentation discussed a proposed business model on the fabrication of safety-related components before identifying an owner (NRC licensee) that will be submitted for NRC review in NEI guidance NEI 25-05. Unlike the traditional practice where NRC oversight begins at fabrication, the new model would propose NRC oversight and enforcement to begin after a component is fabricated; this approach is expected to promote flexibility in delivery and shorten deployment time for time-sensitive uses. The presentation focused on the following high-level elements of draft NEI 25-05: (1) statutory requirements; (2) applicable NRC requirements; (3)

NRC enforcement and inspections; (4) procurement practices for safety-related components; (5) procurement practices for ASME Code Items; (6) ASME CC N-883 requirements; and (7) future licensee acceptance process. The presentation concluded with a comparison of traditional and alternative approaches. For further details, refer to the NEI presentation cited above.

NEI plans to submit the guidance document (NEI 25-05) at the end of June or early July 2025, including a letter with Revision 2 of CC N-883 for NRC review. NEI would request that the NRC review and provide comments within 60 days and eventually endorse the guidance once finalized. The NRC commented that the agency was working on process enhancements to expedite review and endorsement, aiming to provide clarity and transparency for future

construction projects. The NRC confirmed its commitment to streamlining the endorsement process in order to accommodate an expedited schedule.

There were several comments on the process and applicability of the guidance shared by industry stakeholders attending the meeting; the NRC and NEI staff answered questions and provided clarification, as appropriate. The NRC staff shared insights on references to regulatory authority in Revision 2 of CC N-883.

No regulatory decisions were discussed or made at this meeting.
