The FOIA office received your FOIA request on June 27, 2025, and tasked the Atomic Safety and Licensing Board Panel (ASLBP) to locate any responsive records. ASLBP staff informed us that the NRC is prohibited from using appropriated funds to compensate intervenors in adjudicatory proceedings (see section 502 of the Energy and Water Development Appropriations Act, 1993 (5 U.S.C. 504 note; Public Law 102 -377)). By way of background, ASLBP staff also noted that, for a brief period starting in July 1980, the NRC implemented a pilot program to provide assistance to intervenors in the form of free transcripts and service of documents. That program was suspended following the issuance of an opinion from the Comptroller General that appropriated funds could not be used for that purpose (see 46 Fed. Reg. 13,681 (Feb. 24, 1981)).
Given this long-standing prohibition on intervenor funding, ASLBP staff informed us that they do not maintain any records responsive to the request. However, after searching the NRC's official record repository, Agencywide Documents Access and Management System [ADAMS], they located the following documents predating the Comptroller General opinion that may be of interest to you: ML19327A342; ML19344A385; ML19338F829; ML13304A621; ML16358A493 (specifically 12 NRC 665 (1980)). One additional document, ML17340A511, provides background on the suspension of the pilot program.
