REQUEST FOR RELIEF/EXTENSION FOR TITLE 10 OF THE CODE OF FEDERAL REGULATIONS SECTION 74.13(a)

Dear Mr. Ho:

This letter provides the U.S. Nuclear Regulatory Commission (NRC) response to your request for relief from requirements in Title 10 of the Code of Federal Regulations (10 CFR) Part 74, for the filing of certain reports to the NRC.

BACKGROUND By email dated July 25, 2025 (Agencywide Documents Access and Management Systems (ADAMS) Accession Number ML25211A156), the licensee, Vogtle Electric Generating Plant, requested an extension for the filing of the Material Status Report for the facility, reporting as identification symbol (RIS code) XIJ. As required by 10 CFR 74.13(a), Material status reports, these reports are to be submitted within 60 calendar days of the beginning of the physical inventory. XIJ is due to submit a material status report to the Nuclear Materials Management and Safeguards System (NMMSS) by July 31, 2025. Your email cites a required software application update needed to properly account for new higher-assay low-enriched uranium (E2) in inventory. You have indicated that a quality check of the data will be finalized, and a material status report will be submitted by August 8, 2025.

DISCUSSION The regulations in 10 CFR 74.13(a) state that The Commission may permit a licensee to submit the reports at other times for good cause. The NRC staff has reviewed this request and finds that the licensee has demonstrated sufficient justification to allow the licensee to report by August 8, 2025. This extension is permissible under 74.13(a) with demonstration of good cause.

Furthermore, the licensee continues to maintain control and accounting of its material will submit the reports within a reasonable extension period.

If XIJ does not believe it can meet the new date, XIJ shall contact the NRC as soon as possible and request a specific exemption from reporting, as described under 10 CFR 74.7. Failure to receive an exemption prior to August 8, 2025, may result in noncompliance with July 30, 2025
