UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION In the Matter of LONG MOTT ENERGY, LLC (Long Mott Generating Station)

Docket No. 50-614-CP ORDER On June 10, 2025, the Nuclear Regulatory Commission (NRC) issued a notice in the Federal Register providing an opportunity to request a hearing and petition for leave to intervene with respect to Long Mott Energy, LLCs application for a construction permit for a four-unit reactor facility to be built in Calhoun County, Texas.1 The Federal Register notice set a deadline of August 11, 2025, for filing a request for a hearing or a petition for leave to intervene.2 Former Texas State Representative Lon Burnam; Karen Hadden of Texas Nuclear Watchdogs; and Tom Smitty Smith, the former director of Public Citizens Texas Office (collectively known as Requesters) seek a four-month extension of the August 11, 2025, deadline to file a request for hearing or petition for leave to intervene.3 Reasons for the request 1 Long Mott Energy, LLC.; Long Mott Generating Station; Construction Permit Application; Acceptance for docketing, opportunity to request a hearing and petition for leave to intervene; order imposing procedures, 90 Fed. Requesters also ask for a public meeting and public comment period of four months and that a full environmental impact statement, rather than an environmental assessment be required. Id.

These requests have been referred to the NRC Staff for appropriate action.

2 include: (1) the voluminous and complex nature of the application materials, (2) the fact that the NRC has not yet approved the reactor design, (3) the novel reactor design, (4) the need for additional time for potential parties to become familiar with NRC rules, regulations, and procedures, and (5) emerging security and cybersecurity concerns, including threats of drones, hacking and potential misuse of artificial intelligence.4 On July 14, 2025, I issued an order denying a similar request for an extension to the deadline to request a hearing or petition to intervene. Like the arguments addressed in that order, Requesters arguments, without more, do not constitute good cause to grant an extension to the deadline to request a hearing or petition to intervene.5 Pursuant to my authority under 10 C.F.R. § 2.346(b) and (j), I therefore deny Requesters request for an extension to the filing deadline in this matter.
