On Monday June 9, 2025 at 9:00 a.m., Global Laser Enrichment LLC (GLE), Burns & McDonnell Engineering Company, Inc.
(Burns & McDonnell), Boston Government Services, LLC (BGS), DeMase Technical Services, LLC (DeMase), and Bacon Farmer Workman Engineering & Testing, Inc. (BFW) had a pre-application meeting with the U.S. Army Corps of Engineers (USACE)
Louisville district to discuss the proposed GLE Paducah Laser Enrichment Facility (Project). An approved jurisdictional determination request was submitted to the USACE on December 3, 2024, and was assigned USACE ID No.: LRL-2025-00040.
To assist with the jurisdictional determination of the wetland features identified in the Wetland Delineation Report for GLE Paducah Laser Enrichment Facility-November 11, 2024, Burns & McDonnell was requested to conduct a review of the perimeter wetlands and streams that extended off the Project Area (322 acres). This review was to confirm if there was a continuous surface connection with a relatively permanent water (RPW) or its abutting wetlands to bodies that are waters of the U.S. in their own right. Upon conclusion of that review, Burns & McDonnell would provide its scientific opinion on the jurisdictional status of the onsite features for the USACE to review.
A supplemental field assessment to identify potential continuous surface connections to regulated waters was conducted by BFW on June 17, 2025. Based in part on that supplemental field assessment and a review of the initial delineation, the anticipated jurisdictional status of all the Projects wetlands and streams with supporting rationale are detailed below in Tables 1, 2, and 3. Supporting figures reflecting the jurisdictional status in the tables are provided in Attachment 1: Updated Figures. The supplemental assessment summary from BFWs site visit is included in Attachment 2: Supplemental Report.

7 Conclusions Burns and McDonnell is submitting this wetland delineation report supplemental memorandum to include additional information on the anticipated jurisdictional status of the wetland, stream, and pond features identified on the GLE PLEF Project Area. Based on the evaluation and supplemental field assessment, 11 wetlands, five streams, and no ponds appear to have continuous surface connectivity via RPWs to water bodies that are waters of the U.S. in their own right. It is Burns &
McDonells scientific opinion that these resources would be considered jurisdictional by the USACE. (BFW) is pleased to submit supplemental information related to the jurisdictional connections for a water/wetland delineation for the Global Laser Enrichment (GLE) Paducah Laser Enrichment Facility (PLEF) located in McCracken County, Kentucky. The initial delineation report by Burns & McDonnell dated November 11, 2024.
Summary of Previous Delineation Report: The delineation for the work area associated with the PLEF Project Area was completed by Burns & McDonnell and documented in a report dated November 11, 2024 that was submitted to the U.S. Army Corps of Engineers (USACE) as part of the project permit application. This report presented the environmental setting of the project, regulatory and technical definitions, and methods and materials. The delineation documented 38 wetlands, 20 streams, and six ponds within the PLEF Project Area but did not assess the potential status of these features.
Reassessment of Potential Jurisdictional Water/Wetland Features: On Monday, June 9, 2025, GLE, BFW, BGS, and Burns & McDonnell met with USACE to discuss the project and the previously submitted Delineation Report. During that meeting, project manager, Meagan Knuckles, requested additional information on the reporting to determine which features would be jurisdictional. To support this effort, BFW staff conducted a field visit on June 17, 2025 to reassess several previously delineated water/wetland features as identified by Burns &
McDonnell. The primary objective was to evaluate the physical characteristics and hydrologic connectivity of these features to determine their potential jurisdictional status. A photo map is attached in Appendix A and photographs of the associated water/wetland features are provided in Appendix B.
The June 2025 visit to the PLEF area occurred after recent rain events and directly after a rainfall event that accumulated slightly less than an inch. Site observations during the visit included saturated soils, standing water, and drainage patterns. The USACE Antecedent Precipitation Tool (Deters, 2023) rated June 17, 2025 as Wetter than Normal - 16. The Antecedent Precipitation Tool output for the visit on June 17 depicts the 30-day rolling rainfall total in comparison to 30-year normal precipitation ranges. The APT is included in Appendix C.
Ephemeral streams were characterized as typically having flowing water only during rainfall events and for a short time afterward in a typical year. Ephemeral stream beds are located above the water table year-round, so groundwater is not a source of water for the stream. Runoff from precipitation is the primary source of water for stream flow.
Non-jurisdictional ditches were classified according to the definition presented by the EPA within the Revised Definition of Waters of the United States issued on January 18, 2023. These features are defined as being ditches (including roadside ditches) excavated wholly in and draining only dry land and that do not carry a relatively permanent flow of water.
The June 2025 reassessment documented one previously delineated area which appeared to be jurisdictional.
The Wetland WA11 complex measures approximately 1.00 acres within the study area and is comprised of a forested wetland (PFO) and emergent wetland (PEM). See below for descriptions on all water/wetland features assessed. Photographs are included in Appendix B.

Based on the lack of hydrologic connection to a downstream jurisdictional water, it appears that it would be interpreted as non-jurisdictional.
Wetland WA03 is located within a shallow depression. It drains into a ditch on the western portion of the site that does not have relatively permanent flow. While the wetland is connected to downstream waters, the lack of permanent flow suggests it would likely be interpreted as non-jurisdictional.
Wetland WA04 is a wetland fringe adjacent to Pond PA02 and did not contain identifiable drainage features. Based on the lack of hydrologic connection to a downstream jurisdictional water, it appears that it would be interpreted as non-jurisdictional.
Wetland WA11 is located within a depression north of a berm for Pond PA05 and drained into a relatively permanent water that flows west offsite, eventually draining into the Ohio River. The drainage was evaluated for indicators of relatively permanent flow. Observations included the presence of iron bacteria, hydrophytic vegetation, and amphibians. Thus, it appears that it would be interpreted as jurisdictional.
Wetland WA12 is located in a grassy swale and shallow depression but did not have identifiable drainage features.
Based on the lack of hydrologic connection to a downstream jurisdictional water, it appears that it would be interpreted as non-jurisdictional.

Wetland WA16 is located within a broad depression. It drains into an upland ditch on the northern side and did not have identifiable drainage features. While the wetland is connected to downstream waters, the lack of permanent flow suggests it would likely be interpreted as non-jurisdictional.
